HomeMy WebLinkAboutResolutions - R-12-013 - 05/07/2012 - DESIGNATING FOIA AND OMA OFFICERSR-12-013 RESOLUTION DESIGNATING FREEDOM OF INFORMATION ACT AND OPEN MEETINGS ACT OFFICERS AS REQUIRED BY THE ILLINOIS FREEDOM OF INFORMATION ACT WHEREAS, on June 26, 2009 the Illinois General Assembly passed Senate Bill 189 which the Governor signed into law on August 17, 2009, as Public Act 96-542 ("Act"); and WHEREAS, the Act made changes to the State's public access laws including both the Freedom of Information Act (hereinafter "FOIA") and the Open Meetings Act (hereinafter "OMA"); and WHEREAS, the City Council of the City of McHenry is charged by virtue of the passage of the Act to designate FOIA Officers whose responsibilities shall include: • Accepting, approving, partially denying, or denying FOIA requests submitted to any office of the City of McHenry; and • Providing FOIA requestor(s) with information requested as per the provisions of the Act; and • Informing recipient(s) of requested information they have the right to appeal the decision of the FOIA Officer to the Office of the Illinois Attorney General's Public Access Counselor. WHEREAS, the City Council of the City of McHenry is charged by virtue of the passage of the Act to designate OMA Officer(s) whose responsibilities shall include: • Annual training in the State of Illinois Open Meetings Act; and • Respond to any and all suspected violation(s) of the OMA and assist Illinois Attorney General's Public Access Counselor in complaint and investigation procedures with regard to said alleged violation(s); and • Advise and inform City Council and staff of potential violation(s) of OMA; and • Assist complying with all provisions of the OMA with regard to local municipal government meetings of City Council, Committees, Boards and Commissions. NOW, THEREFORE, be it resolved that the City Council of the City of McHenry does hereby go on record designating Dorothy Wolf to be FOIA Officer and Douglas P. Martin to be Alternate FOIA Officer and designating Dorothy Wolf and Douglas P. Martin OMA Officers of and for the City of McHenry effective as of the date of passage of this instrument. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to file a duly certified copy of this resolution with the Illinois Attorney General's Office of the Public Access Counselor.
