AN ORDINANCE AUTHORIZING THE MAYOR'S EXECUTION OF A MEMORANDUM OF
UNDERSTANDING PERTAINING TO THE DRAINAGE DITCH LOCATED ON BOONE
VALLEY PLAT NUMBER SEVEN BETWEEN THE CITY OF MCHENRY AND MCHENRY HIGH
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage
of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in
the Constitution of the State of Illinois.
NOW, THEREFORE, BE lT ORDAINED by the CITY COUNCIL of the CITY OF MCHENRY, McHenry
County, Illinois, as follows.
SECTION 1: The Memorandum of Understanding, bearing the dafie of January 18, 2016,
between the City of McHenry and McHenry High School District 156 is attached to this ordinance and
incorporated herein by reference as EXHIBIT A.
SECTION 2: The Mayor and City Clerk are hereby authorized to affix their signatures as
Mayor and City Clerk to said for the uses and purposes therein set forth.
SECTION 3: All Ordinance or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided bylaw.

DITCH ON BOONE VALLEY PLAT NUMBER SEVEN

This memorandum serves as a general understanding and/or agreement, outlining the basic terms of
this transaction between the City of McHenry ("CITY") and McHenry Community High School District
156 ("DISTRICT 156") pertaining to the properties located at 4724 and 4716 W Crystal Lake Road,
McHenry, IL 60050 commonly known as McHenry High School West Campus, generally located on the
west side of Crystal Lake Road north of Kensington Drive and south of Royal Drive consisting of
approximately 46 acres ("SUBJECT PROPERTY") and referencing lots adjacent to the SUBJECT
PROPERTY as well as to the southwest of the SUBJECT PROPERTY.
1. DISTRICT 156 agrees to perpetually maintain the drainage ditch, which is generally located
at the southern portion of the SUBJECT PROPERTY, at the location depicted on attached
Exhibit -Al ("D156 DRAINAGE EASEMENT") and Boone Valley Plat No. 7 attached as
Exhibit-A2 ("BOONE VALLEY PLAT NO. 7"). The D156 DRAINAGE EASEMENT is located
within the area on BOONE VALLEY PLAT NO. 7 labeled Lot "A."
2. DISTRICT 156 agrees to perpetually maintain the rip rap and detention area, which is
generally located at the south:.�est portion of the S! IBJECT PROPERTY, at the location
depicted on attached Exhibit-A3 ("D156 RIP RAP/DETENTION") and on BOONE VALLEY
PLAT NO. 7 east of and adjacent to Lot 10 and extending east to Lot 13. Maintenance of
the D156 DRAINAGE EASEMENT and D156 RIP RAP/DETENTION shall include: cutting
down, removing, trimming trees, shrubs, saplings and/or other vegetation that could
potentially interfere with and/or impede the flow and/or conveyance of water through the
Drainage and Utility Easement depicted on BOONE VALLEY PLAT NO. 7. The
aforementioned drainage and utility easement commences at Lot 39 at the southern end
of the SUBJECT PROPERTY and thereafter extends west and terminates at Lot 1, located at
northeast corner of Kensington Drive and Oakwood Drive. Photographs of the RIP
RAP/DETENTION AREA and DRAINAGE DITCH referenced herein are depicted on attached
Exhibit-A3
3. The CITY agrees to maintain the CITY DRAINAGE DITCH, generally described as the green
area lying immediately to the north of Lots 1-3 on BOONE VALLEY PLAT NO. 7 and depicted
on Exhibits "A" and "B" ("CITY DRAINAGE DITCH"). Maintenance of the DRAINAGE DITCH
shall include: cutting down, removing, and trimming trees, shrubs, saplings and/or other
vegetation that could potentially interfere with and/or impede the flow and/or
conveyance of water to the southwest of the SUBJECT PROPERTY.
4. By signing this memorandum, each party agrees that they understand, are in full
agreement with and will completely abide by any and all points outlined in this letter and
the terms outlined herein shall remain in full force and effect unless otherwise amended
by written instrument by both parties.
