ORDINANCE NO. 16-1770
AN ORDINANCE AUTHORIZING THE MAYOR'S EXECUTION OF A MEMORANDUM OF
UNDERSTANDING PERTAINING TO THE SCHOOL BUS LANE AT MCHENRY HIGH
SCHOOL WEST CAMPUS BETWEEN THE CITY OF MCHENRY AND MCHENRY HIGH
SCHOOL DISTRICT 156
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage
of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in
the Constitution of the State of Illinois.
NOW; THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF MCHENRY, McHenry
County, Illinois, as follows.
SECTION 1: The Memorandum of Understanding, bearing the date of January 18, 2016,
between the City of McHenry and McHenry High School District 156 is attached to this ordinance and
incorporated herein by reference as EXHIBIT A.
SECTION 2: The Mayor and City Clerk are hereby authorized to affix their signatures as
Mayor and City Clerk to said for the uses and purposes therein set forth.
SECTION 3: All Ordinance or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law. -

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MCHENRY AND
MCHENRY COMMUNITY HIGH SCHOOL DISTRICT lab PERTAINING TO THE SCHOOL
BUS LANE AT MCHENRY HIGH SCHOOL WEST CAMPUS
January 18, 2016
This memorandum serves as a general understanding and/or agreement, outlining the basic terms of
this transaction between the City of McHenry ("CITY") and McHenry Community High School District
156 ("DISTRICT 156") pertaining to the properties located at 4724 and 4716 W Crystal Lake Road,
McHenry, IL 60050 commonly known as McHenry High School West Campus, generally located on the
west side of Crystal Lake Road north of Kensington Drive and south of Royal Drive consisting of
approximately 46 acres ("SUBJECT PROPERTY") and referencing lots adjacent to the SUBJECT
PROPERTY as well as to the southwest of the SUBJECT PROPERTY.
1. DISTRICT 156 agrees to utilize the driveway, generally located at the northwest corner of
the SUBJECT PROPERTY, which extends from the SUBJECT PROPERTY onto Oakwood Drive,
and depicted on attached Exhibit "A" ("SCHOOL BUS DRIVEWAY"), primarily for the ingress
and egress of school buses.
2. Signs stating "DO NOT ENTER" shall perpetually be posted at the SCHOOL BUS DRIVEWAY
facing towards Oakwood Drive and the gate which crosses the driveway shall be opened at
6:30 a.m. and closed at 4:00 p.m. daily when school is in session to facilitate the
movement of school bus traffic. .
3. By signing this memorandum, each party agrees that they understand, are in full
agreement with and will completely abide by any and all points outlined in this letter and
the terms outlined herein shall remain in full force and effect unless otherwise amended
by written instrument by both parties.
