MC-16-1130.A AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 12, ARTICLE III RAFFLES, OF THE CITY OF MCHENRY'S MUNICIPAL CODE WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. WHEREAS, at its July 18, 2016 meeting, the City Council approved an Ordinance authorizing an amendment to Municipal Code Chapter 12, Licenses and Permits Generally to include the addition of Article III, Raffles. NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois, Municipal Code Chapter 12, Article III Raffles, is amended as follows: SECTION 1: Section 12-58 (H) is amended to reflect the following: H. Each license issued under this article shall be valid for a single raffle, or a specified number of raffles to be conducted during a specific period not to exceed one (1) year. SECTION 2: Section 12.65 (B) is deleted in its entirety and reserved to reflect the following: SECTION 3: Section 12.65 (D) is amended to reflect the following: D. Each organization licensed to conduct raffles shall report promptly after the conclusion of each raffle to its membership. Each organization licensed to conduct raffles shall report within ten (10) business days to the City of McHenry its gross receipts, expenses and net proceeds from the raffle, and the distribution of net proceeds as required by this section. This information shall be reported using the "Not -for -Profit Raffle License Audit Information" form as provided. SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Page I of 2 SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
