Green Street ) Ordinance No. 0-94-684 McHenry, Illinois 60050 ) Zoning File No. _Z=3=390 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY, ILLINOIS, BY GRANTING A CONDITIONAL USE THEREON Whereas, a written Petition signed by McHenry Elementary School District '15 and McHenry Public Library District Board has been filed with the City Clerk of the City of McHenry, Illinois requesting the granting of a conditional use variation under the provisions of the Zoning Ordinance of the City of McHenry, as amended, concerning the following described premises: A part of Lot 1, described as follows: Beginning on the Southerly line of Main Street as a point 118 feet Easterly from the Northwest comer of said Lot 1; running thence Southerly on and along the Easterly line of a lot of land deeded by William Tesch and wife, to Henry Heiser by Warranty Deed dated the 11 th day of September A.D. 1906 and recorded in the Recorder's Office of McHenry County, Illinois, in Book 118 of Deeds on page 477, a distance of 132 feet, more or less, to the Southerly line of said Lot 1, running thence Easterly on and along the Southerly line of said Lot 1, a distance of 66 feet, running thence North 15 314 degrees East 132 feet, more or less, to the Southerly line of the aforesaid street, running thence Westerly on and along the Southerly line of the aforesaid street 66 feet to the place of beginning in Block 8 in the Original Plat of West McHenry, being a part of the Southwest Quarter of Section 26 and the Northwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded June 14, 1859 in Book 24 of Deeds, page 22, in McHenry County, Illinois. AND Part of Lot 1, in Block 8 of the Original Plat of West McHenry, according to the Plat thereof recorded in the Recorder's Office of McHenry County, Illinois, in Book 24 of Deeds, page 23, described as follows, to -wit: Beginning at a point on the West line of Elgin Road 60 feet Northerly of the Southeast comer of said Lot 1, thence Westerly parallel with the Southerly line of said Lot 1 to the Easterly line of a piece of land conveyed by William Tesch and wife to William G. Schreiner Jr., by warranty deed dated September 19, 1910 and recorded in the Recorder's Office in Book 131 of Deeds, page 273, thence Northeasteriy along the Easterly line of said piece of land so conveyed to William G. Schreiner Jr. to the Northeast comer thereof and the Northerly line of said Lot 1, thence loutheasterly along the Northerly line of said Lot 1 to the Northeast corner of said Lot 1, thence Southerly along the Easterly line of said Lot 1 to the place of beginning, said block being located in and being a part of the Northwest Quarter ��I of Section No. 35, Township 45 North, of Range 8, East of the Third Principal Meridian, situated in the county of McHenry in the State of Illinois. commonly known as, 1011 N. Green Street; McHenry Public Library Building. Whereas, said Petitioners are requesting a conditional use to permit the operation of an educational administrative office, pursuant to the City of McHenry Zoning Ordinance; and, Whereas, a hearing was held before the City of McHenry Zoning Board of Appeals on December 5, 1994, at which time the Zoning Board of Appeals did take evidence and view exhibits presented thereat by the Petitioners; and, Whereas, based on evidence heard, the Zoning Board of Appeals found that there was no overriding reason for not granting the requested zoning variation; and, Whereas, the Zoning Board of Appeals found, and the City Council concurs in that finding, that it would serve the interests of the City of conditional use was granted for operation as an educational institution administrative office, in that: A. The proposed use will not cause any adverse impact of types or volumes; of traffic flow. B. The proposed use will have no adverse effects of noise, glare, odor, dust, waste disposal, blockage of light or air, or other adverse environmental effects. C. The proposed use will fit harmoniously with the existing natural or man-made character of its surroundings, and with permitted uses in the zoning district. 'The use will not have undue deleterious effect on the environmental quality, property values, or neighborhood character already existing in the area, or normally associated with permitted uses in the district. D. The proposed use will not require existing community facilities or services to a degree disproportionate to that normally expected or permitted uses in the district, nor generate disproportionate demand for new services or facilities, in such a way as to place undue burdens upon existing development in the <area. E. The proposed use will not be detrimental to the safety or health of the employees, patrons, or visitors associated with the use nor of the genre\eral public in the vicinity. F. The proposed use is in harmony with all other elements of compatibility pertinent to the conditional use and its particular location. Now, therefore, be it ordained by the City Council of the City of McHenry, Illinois, as follows: Section 1: That a conditional use is hereby granted on the foregoing legally described property, commonly known as 1011 N. Green Street, McHenry, Illinois 60050, but that, even with said conditional use, the subject property owners will still be required to comply with all requirements as to new construction. Section 2: All ordinances, or parts thereof, in conflict with the terms and provisions hereof, are hereby repealed to the extent of such conflict. Section I This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. Section 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form, as provided by law. Passed this 21st day of December , 1994.
