AN ORDINANCE PROHIBITING THE DISCHARGE OF SANITARY AND
INDUSTRIAL WASTE WATER INTO FRONT STREET (IL. ROUTE 31)
STORM SEWERS AND/OR INTO ANY STORM SEWERS WITHIN THE CITY OF McHENRY
WHEREAS, the City of McHenry hereinafter known as the City, and the
State of Illinois, acting by and through its Department of Transportation,
Division of Highways, have entered into an agreement relative to the
installation of traffic signals and all incidental work at the intersection
of Front Street (IL. Route 31) and Prime Parkway, identified as MFT Section
94-00050-00-TL and State Job No. C-92-309-94; and
WHEREAS, the City of McHenry has for many years prohibited the
discharge from sanitary and industrial waste water into any storm sewer
within the City.
NOW, THEREFORE, BE IT ORDAINED, by the City of McHenry, in the County
of McHenry, in the State of Illinois:
SECTION 1. It shall be unlawful for any person, firm or corporation to
discharge sanitary and industrial waste water into the storm sewers
constructed as part of the Front Street (IL. Route 31) and Prime Parkway
improvement, nor shall there be any discharge of waste water into any storm
sewer in McHenry.
SECTION 2. That any person, firm or corporation violating this
Ordinance shall be fined not less than $25.00 nor more than $500.00 for each
offense, and separate offenses shall be deemed committed for each and every
day during which a violation continues or exists.
SECTION 3. That all Ordinances or parts of Ordinances in conflict with
the provisions of this Ordinance are hereby repealed to the extent of such
conflict.
SECTION 4. That this Ordinance shall be in full force and effect from
and after its passage and approval as provided by law.
