HomeMy WebLinkAboutOrdinances - O-73-56.5 - 07/02/1973 - RECLASS VARIOUS PROPERTIES FOR MUNICIPAL WATER PUM0-5(,c,'�- AN ORDINANCE AMENDING CERTAIN PROVISIONS OF THE ZONING ORDINANCE OF THE CITY OF McHENRY WHEREAS, a -public hearing was had before the Zoning Board of Appeals of the City of McHenry pursuant to proper authority and proper notice therefor having been effected through publication as by statute provided; and WHEREAS, the said Zoning Board of Appeals heard and considered evidence at said hearing in regard to the allegations contained in said Petition; and WHEREAS, as a result of said hearing the Zoning Board Of Appeals of the City o= McHenry did make and deliver recommendations in regard thereto to the City Council of the City of McHenry; and WHEREAS, said Zoning Board of Appeals of the City of McHenry did recommend the zoning reclassification of the real estate hereinafter described to the zoning classifications hereinafter indicated; and WHEREAS, the City Council has considered the content of such recommendation. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of McHenry that the Zoning Ordinance of the City of McHenry, as passed and approved on the 12th day of March, 1962, and such Ordinance as subsequently amended, be and hereby is amended as follows: SECTION 1. That the following described real estate is hereby reclassified from "R-1" Single Family District Classification to "R-3" Single Family District Classification: Lots 1 and 2 in Block 1 in Hay Heights Subdivision, a Subdivision of Lots 3 to 8 in Kelter Estates Subdivision, Unit No. 2, a Subdivision of part of the East Half of Section 34, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded May 10, 1955 as Document No. 292394 in Book 12 of Plats, page 25, in McHenry County, Illinois. Also: Lot 1 in E. B. Crooks River Road Subdivision according to the Plat thereof recorded in the Recorder's Office in 13ooic 3 o. PlAtc-1 page 73: ezid SW;-divi,eion being located in the Fractional Southeast Quarter of the Fractional Northeast Quarter of Fractional Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry'County, Illinois. Also: i.ots 37, 38, 39, 40, 41, 42, 43 and 44 in Owen, Stenger & Allen's First Addition to the City of McHenry, being a Subdivision of part of the North Half of Fractional Sections 35 and 36 in Township 45 North, Range 8 East of the Third Principal Meridian, lying West of the Fox River, according ro the Plat thereof recorded April 12, 1922 as Document No. 54652 in Book 4 of Plats, page 54, in McHenry County, Illinois. Also: Lots 105 and 106 in McHenry Golf Course Subdivision, Fox River Addition, being a Subdivision of part of the i Northeast Quarter of Section 35 and the Northwest Quarter I of Section 36, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded October 210 1929, as Document No. 90215, in j Book 8 of Plats, page 2, in McHenry County, Illinois. —2— Also; i Lots 1 through 19 inclusive in Block 1; Lots 1, 2, 4, 5 and 6 in Block 2; Lots 1 through 9 inclusive in Block 3; and Lots 1 through 7 inclusive in Block 4; all in Country Club Estates, according to the Plat thereof recorded October 17, 19560 as Document No. 314307 in Book 12 of Plats at page 91, McHenry County, Illinois. SECTION 2, That the following described real estate is hereby reclassified from "R-1" Single Family District Classification to "R-2" Single Family District Classification: Lot 10 in Kelter Estate Subdivision, Unit No. 1, a Subdivision of part of the North Half of Section 34, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded March 14, 1949 as Document No. 218953, in Book 10 of Plats, page 112, in McHenry County, Illinois. That the following described real estate is hereby granted a Special Use Permit to enable it to continue the operation thereon of a municipal water and pumping filtration plant: ;parcel 1: Lots 13 and 14 in Edgebrook Heights Annex, a Subdivision of part of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third prin- cipal Meridian, according to the Plat thereof recorded February 14, 1957 as Document No. 319418 in Book 13 o: Plats, page 9, in McHenry County, Illinois. SECTION 4. That the following described real estate is hereby granted a Special Use Permit to enable the City of McHenry to maintain the existing water supply system lvoated thereon as a standby municipal water supply system: Lot 3 in Block 2 in Country Club Estates, a Subdivision of part of the South Half of the Southeast Quarter of Section 35, Township 45 North, Range 8 East- of the Third Principal Meridian, according to the Plat thereof recorded October 17, 1956 as Document No. 314307, in Book 12 of Plats, page 91, in McHenry County, Illinois. J SECTION 5. Paragraph 9 of Article IV of the Zoning Ordinance of the City of McHenry, as passed and approved on the 12th day of March, 1962, is hereby repealed. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law provided. -5- PASSED this 2nd day of July, 1973.
