AN ORDINANCE VARYING THE TERMS AND PROVISIONS
OF THE ZONING ORDINANCE OF THE CITY OF McHENRY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, as follows:
SECTION I. A variation in the zoning requirements of the City of
McHenry is hereby allowed to the property described as
Part of the Northwest Quarter of the Southwest Quarter
of Section 35, Township 45 North, Range 8 East of the
Third Principal Meridian, lying on the Easterly side of
the State Highway, described as follows: Commencing at
the West Quarter Corner of Section 35 and running thence
Easterly on the East and West Quarter Section line, 715.0
feet to an intersection with the East line of theState
Highway (now known as Route No. 31) for a place of beginning;
thence Easterly on said East and West Quarter Section line,
606.65 feet to the East line of said Northwest Quarter of
the Southwest Quarter of said Section; thence Southerly on
said East line thereof, 144.05 feet; thence Westerly on a
line parallel with said East and West Quarter Section line,
603.08 feet to an intersection with the East line of said
State Highway; thence Northerly on said East line of said
State Highway 144.03 feet to the place of beginning (except-
ing therefrom the West 185 feet of the North 117.73 feet
thereof), in McHenry County, Illinois.
to permit the utilization of the 27-foot roadway fronting on the
highway commonly known as Route 31 and servicing the above described
premises, thereby permitting construction of three residential units
on said property, all in accordance with the terms and provisions
specified under the "R-2" classification in the McHenry Zoning
Ordinance.
SECTION 2. This variation is hereby granted on the express condi-
tion that the 27-foot roadway shall be improved in accordance with
City construction specifications for secondary streets, including
"A-2" surfacing.
SECTION 3. That by the granting of this variation, the City of
McHenry does not accept any responsibility for the maintenance and
servicing of the aforementioned 27-foot roadway, said roadway to
remain as the private property of the owners of the real estate,
their successors and assigns.
SECTION 4. That this variation is hereby granted following proper
application having been made therefor before the Zoning Board of
Appeals of the City of McHenry, McHenry County, Illinois, due and
proper notice of which was given to all interested parties in
accordance with the provisions of the Zoning Ordinance of the City
of McHenry and public hearing held by and before the Zoning Board
of Appeals of the City of McHenry, McHenry County, Illinois, and
upon unanimous affirmative recommendation of all of the members
of said Zoning Board of Appeals present and voting upon said applica-
tion.
SECTION 5. This Ordinance shall be in full force and effect from
and after its passage and approval according to law.
