ZONING ORDINANCE OF THE CITY OF McHENRY
BE IT ORDAINED by the City Council of the City of McHenry,
McHenry County, Illinois, as follows:
SECTION I: That the following described premises and real
estate, to -wit:
All that part of Block 9, lying North of the North
line of a parcel of land conveyed by Alsena Smith,
et al, to Henry Kamholtz by Warranty Deed dated
August 28, 1911, and recorded in Book 135 of Deeds,
page 15, (excepting and reserving therefrom that
part thereof conveyed by Frank H. Wattles and wife,
to Edward Mischke by Warranty Deed dated October 27,
1928 and recorded in Book 189 of Deeds, page 437),
in Wattles' Second Addition to McHenry, a Subdivision
of part of Out -Lots 1, 2, 11, 13 and 14 of County
Clerk's Plat and lying in the Northwest Quarter of
Section 353, Township 45 North, Range 8 East of the
Third Principal Meridian, according to Plat thereof
recorded April 8, 1927 as Document No, 77644, in Book
5 of Plats, page 94, in McHenry County, Illinois,
be and the same is hereby reclassified from "R-l" Single -Family
District to "R-4" Multi -Family District under the provisions of
the Zoning Ordinance of the City of McHenry, Illinois.
SECTION II: That said reclassification is hereby granted
following proper application having been made therefor before the
Zoning Board of Appeals of the City of McHenry, Illinois, with due
and proper notice of which was given to all interested parties in
ccordance with the provisions of said Ordinance, and a public hearing
_eld by and before the Zoning Board of Appeals of the City of McHenry,
and upon unanimous affirmative recommendation of all of the members
of said Zoning Board of Appeals present and voting upon said
application and all conditions specified by said Zoning Board of
Appeals having been met.
SECTION III: This Ordinance shall be in full force and effect
from and after its passage and approval according to law and all
conditions specified in zoning recommendations have been met.

A G R E E M E N T
We, the undersigned, the Owner and Contract Purchasers of the
premises and real estate described as:
All that part of Block 9, lying North of the North
line of a parcel of land conveyed by Alsena Smith,
et al, to Henry Kamholtz by Warranty Deed dated
August 28, 1911, and recorded in Book 135 of Deeds,
page 15, (excepting and reserving therefrom that
part thereof conveyed by Frank H. Wattles and wife,
to Edward Mischke by Warranty Deed dated October 27,
1928, and recorded in Book 189 of Deeds, page 437)
in Wattles' Second Addition to McHenry, a Subdivision
of part of Out -Lots 1, 2, 11, 13 and 14 of County
Clerk's Plat and lying in the Northwest Quarter of
Section 35, Township 45 North, Range 8 East of the
Third Principal Meridian, according to the Plat thereof
recorded April 8, 1927 as Document No, 77644, in Book
5 of Plats, page 94, in McHenry County, Illinois,
'n consideration of the City Council of the City of McHenry, McHenry
unty, Illinois, passing an ordinance reclassifying the above
described real estate from "R-1" Single Family District to "R-4"
Multi -Family District DO HEREBY AGREE that our contract for the
sale and purchase of said real estate shall be amended to add a
further condition specifying that the access driveway serving the
building to be erected on said real estate shall be located as
closely to the East property line as is permitted under the
regulations of the building ordinances of the City of McHenry,
Illinois.
WE DO FURTHER AGREE that said provision shall be strictly
Forced and construction work completed in accordance with this
understanding and agreement.
