MC-96-666 An Ordinance Amending Section 14-4-(13), Disorderly Conduct, of the City of McHenry Municipal Code BE IT ORDAINED BY THE CITY COUNCIL of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That Section 14-4-(13), Disorderly Conduct, of the City of McHenry Municipal Code shall be amended to read as follows: (13) Appears in any public place, or on any private street, road or drive that is the subject of a written request from the property owner pursuant to 625 ILCS 5/11-209.1, and is under the influence of alcohol or controlled substance, to the degree that he may endanger himself or other persons or property, or alarm or disturb other persons in the vicinity. SECTION 2: Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Twenty Five Dollars ($25.00) nor more than Seven Hundred Fifty Dollars ($750.00) for each offense committed on each day during, or on which, a violation occurs or continues. SECTION 3: If any section, paragraph, subsection, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgement shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
