MC-94- 618 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, McHENRY COUNTY, ILLINOIS, as follows: SECTION 1. Section 27-1 of the Municipal Code, City of McHenry, Illinois, relating to the Definition of Wrecked, Junked & Abandoned Vehicles is hereby amended to read as follows: "Sec. 27-1. Definition. For purposes of this Chapter, "inoperable motor vehicle" means all motor vehicles which, in their present state or condition, cannot be driven on a public street or highway in full compliance with all provisions of the Illinois Vehicle Code (625 ILCS 5/1-101, et seq.), and ordinances of the City of McHenry, and which have remained in such a state or condition for a period of seven (7) consecutive days. This definition shall not include: (a) A motor vehicle which has been rendered temporarily incapable of being driven under its own power in order to perform ordinary service or repair operations; (b) Any motor vehicle that is kept within a building when not in use; (c) Historic vehicles over twenty-five (25) years of age; (d) A motor vehicle on the premises of a place of business engaged in the wrecking or junking of motor vehicles. SECTION 2. Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Twenty Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00) for each offense committed on each day during, or on which, a violation occurs or continues. SECTION 3. All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 4. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication, as probided by law. PASSED this 29th day of June, 1994.
