AN ORDINANCE
ORDINANCE NO. MC-83-272
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That Section 7-19 of the "Municipal Code,
City of McHenry, Illinois" be and thE� same is hereby
amended to read as follows:
Section 7-19. EXTERIOR WALL MATERIALS. Seventy -
Five Percent of the exterior walls of all buildings
and structures, and of all additions to existing
buildings and structures, hereafter erected upon
any premises which are classified under the Zoning
Ordinance of the City of McHenry as "R-4"
Multi -Family District, "R-4A" Multi -Family
District and "R-4B" Multi -Family District, shall be
faced with brick, brick or masonry veneers, natural
or cast stone veneers or other masonry materials.
SECTION 2. That Chapter 7 of thE! "Municipal Code,
City of McHenry, Illinois" be and the same is hereby
amended by adding thereto the following provision as and
for Section 7-20 thereof:
Section 7-20. SMOKE DETECTORS. The installation
of any building hereafter constructed which is to
be used for sleeping or lodging purposes, including
single family dwellings, two-family dwellings,
multiple family dwellings, hotels and motels,
nursing homes and convalescent homes, etc., shall
have a smoke detector installed and in operating
condition on each level of every dwelling unit in
said building and, in addition thereto, (except
single family dwellings) in the hallways and stair-
ways thereof as hereafter provided. A smoke
detector required under this section shall be
approved by Underwriters Laboratory, Inc., or other
comparable testing firm. Each required smoke
detector shall be mounted on the ceiling, or a wall
not more than 12" from the ceiling, at a point
centrally located in a hallway or area giving
access to rooms used for sleeping purposes and not
more than 25 feet apart in such hallway or area.
In an efficiency dwelling unit the detector shall
be centrally located on the ceiling of the main
rooms. Where sleeping rooms are on an upper level,
a detector shall be placed at the center of the
ceiling directly above the stairway. Hallway,
stairway and basement detectors shall be installed
as part of an interconnected system. When
activated, the detector shall provide an audible
alarm in the dwelling unit. Smoke detectors with
D.C. power supply only are permitted, as are detec-
tors with A.C. power supply backed by a secondary
supply which is D.C. An A.C. only powered unit is
not permitted. Where A.C.-D.C. combination units
are used, it is required that all A.C. lines be
wired directly to the building's power supply. The
installation of A.C. powered detectors shall
conform to all electrical standards adopted by the
City. All D.C. power detectors shall have built
in protection to warn of battery failure.
SECTION 3. That Chapter 7 of the "Municipal Code,
City of McHenry, Illinois" be and the same is hereby
amended by adding thereto the following provision as and
for Section 7-21 thereof:
Section 7-21. GARAGES REQUIRED. No permit for the
construction of a new single family residence shall
be issued and no new single family residence may be
constructed unless at least a 1-car garage (either
attached or detacted) is included in the plans and
specifications and in such residential construc-
tion. No occupancy permit for such residence shall
be issue until such garage is completed. A carport
shall not satisfy the garage requirements of this
section. When an attached garage is sought to be
converted to habitable living space, a new
substitute garage must be constructed prior to the
issuance of a conversion permit.
SECTION 4. That Chapter 7 of the "Municipal Code,
City of McHenry, Illinois", be and the same is hereby
amended by adding thereto the following provision as and
for Section 7-22 thereof:
Section 7-22. SUB -SOIL DRAINS: DISCHARGE INTO
SANITARY SEWER PROHIBITED. Sub -soil drains shall
be provided around foundations enclosing habitable
or usable spaces located below grade and which are

subjected to ground water conditions. Drains shall
be installed at or below the area. to be protected
and shall discharge by gravity or by mechanical
means into an approved drainage system. No person
shall discharge or cause to be discharged storm
water, foundation drain water, ground water, roof
run-off, surface drainage, cooling waters, or any
other unpolluted water into any sanitary sewer.
SECTION 5. Any person, firm or corporation violating
any provision of this ordinance shall be fined not less
than Ten Dollars ($10.00) nor more than Five Hundred
Dollars ($500.00) for each offense committed on each day
during, or on which, a violation occurs or continues.
SECTION 6. All ordinances, or parts thereof, in
conflict with the terms and provisions hereof, be and the
same are hereby repealed to the extent of such conflict.
