ORDINANCE NO. MC-13-1068
An Ordinance Amending City of McHenry Municipal Code Chapter 1, General Provisions and
Chapter 7, Buildings and Building Regulations Various Sections
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, AS FOLLOWS:
SECTION 1: Chapter One Sec. 1-2, Rules of Construction and Definitions, of the City of
McHenry Municipal Code is hereby amended by adding thereto the following definition:
"Electrical Contractor: Person engaged in the business of installing or altering by
contract electrical equipment for the utilization of electricity for light, heat, or power.
But the term 'electrical contractor' shall not include the installing or alteration of (1)
radio apparatus or equipment for wireless reception of sounds or signals, or (2)
apparatus, conductors, or other equipment installed for or by public utilities, including
common carriers, which are under the jurisdiction of the Illinois Commerce commission
for the use in the operation as public utilities. Nor shall the term include the employees
employed by an electrical contractor to do or supervise his work."
SECTION 2: That Chapter Seven Sec. 7-121, Electrical Commission established;
membership. of the City of McHenry Municipal Code is hereby amended by deleting therefrom
the entire section.
SECTION 3: That Chapter Seven Sec. 7-122, Duties of Commission, of the City of
McHenry Municipal Code is hereby amended by deleting therefrom the entire section.
SECTION 4: That Chapter Seven Sec. 7-131, Licensing and registration of electrical
contractors, of the City of McHenry Municipal Code is hereby amended by deleting therefrom
the entire section and replacing it with the following language.

"All persons, including electrical contractors as defined herein, engaged in the business of
installing or altering electric equipment shall hold a valid electric license/registration from a
community in the State of Illinois."
SECTION 5: If any section, paragraph, subdivision, clause, sentence or provision of this
ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 6: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 7: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 8: This Ordinance shall be in full force and effect after its passage and
publication in pamphlet form as provided by law.
