ORDINANCE NO. 22-40 Adding Title 15: Fines and Penalties, and Amending Various Sections of the McHenry City Code relating to Fines and Penalties WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. Each day that a violation continues shall be considered a separate offense. SECTION 3: Section 1-4A-2: Settlement of Offenses, of the McHenry Municipal Code, shall be amended as follows: 1-4A-2: SETTLEMENT OF OFFENSES: Offenses may be settled according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties. SECTION 4: Section 1-4B-8: Administrative Hearings: Subsection B, of the McHenry Municipal Code, shall be amended as follows: 1-4B-8: Administrative Hearings: B. Open Hearings; Recording: All hearings shall be open to the public, may be recorded, and shall be conducted before an Administrative Law Judge. SECTION 5: Section 6-5A-8: Loitering: Subsection C: Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5A-8: Loitering: C. Penalty: Any person violating this section shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, for each offense and be responsible for the City's cost of prosecution, including attorney fees incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made to any property damaged or destroyed or person injured. SECTION 6: Section 6-5A-27: Graffiti and Damage to Property, Subsection D: Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5A-27: Graffiti and Damage to Property: D. Penalty; Restitution: A violation of this section is an ordinance violation with a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties. Restitution by the violator shall also be made to the owner of any property damaged or destroyed.Nothing herein shall preclude such additional civil remedies available to the person whose property has been damaged or destroyed. SECTION 7: Section 6-5A-28: Theft, Defacement,Destruction,Alteration or Removal of Government Signs, Subsection B. Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5A-28: Theft, Defacement, Destruction, Alteration or Removal of Government Signs: B. Penalty; Restitution: Any person violating this section shall be punished by a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties and, in addition thereto, shall be required to make restitution for the total material and labor costs of replacing such sign or signs. SECTION 8: Section 6-5A-31: Tobacco Accessories and Use Regulations, Subsection C. 2. Penalty; and Subsection D.2. Penalty; and Subsection E.6. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5A-31: Tobacco Accessories and Use Regulations: C. Purchase And Use of Tobacco Products Prohibited: 2. Penalty: Any person violating any provision of this subsection C is guilty of a petty offense and shall be fined according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties, plus costs associated with the City's cost of prosecution, including attorney fees. D. Possession Of Tobacco Products, Electronic Cigarettes and Their Components, Alternative Nicotine Products or Liquid Nicotine: 2. Penalty: Any person violating any provision of this subsection D is guilty of a petty offense and shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, plus costs associated with the City's cost of prosecution, including attorney fees. E. Tobacco Accessories, Smoking Herbs, Tobacco Products, Electronic Cigarettes, Alternative Nicotine Products or Liquid Nicotine 6. Penalty: Any person, firm or corporation violating any provision of this subsection E shall be subject to license suspension or revocation, alteration of hours on a temporary or permanent basis, and fines according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, for each offense committed on each day during or on which a violation occurs or continues, plus reimbursement of legal fees incurred by the City in the prosecution of violations of this subsection E against the licensee. SECTION 9: Section 6-5C-5: Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5C-5: Penalty; Restitution: Any person violating this chapter shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, for each offense and be responsible for the City's cost of prosecution, including attorney fees, incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made for any property damaged or destroyed or to any person injured. SECTION 10: Section 6-5D-3, Persons Responsible for Unlawful Activities on Premises, Subsection B. Violation: Penalty: Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5D-3: Persons Responsible for Unlawful Activities on Premises: B. Violation; Penalty; Restitution: Any person violating this section shall be fined according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties for each offense and be responsible for the City's cost of prosecution, including attorney fees incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made to any property damaged or destroyed or person injured. SECTION 11: Section 6-5E-1: Parental Responsibility, Subsection C. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5E-1: Parental Responsibility: C. Penalty: Whoever violates any provision of this section shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties for each offense and be responsible for the City's cost of prosecution, including attorney fees, incurred by the City. Each day that a violation continues shall be considered a separate offense. Nothing herein shall preclude such additional civil remedies available to the person whose property has been damaged or destroyed. SECTION 12: Section 6-5E-2: Curfew, Subsection F. Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5E-2: Curfew: F. Penalty; Restitution: Any person violating this section shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties for each offense and be responsible for the City's cost of prosecution, including attorney fees incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made for any property damaged or destroyed or person injured. SECTION 13: Section 6-5E-3: Truancy, Subsection F. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5E-3: Truancy: F. Penalty: A truant who is thirteen(13)years of age or older, or their parent(s), guardian(s) or legal custodian(s), but not both, who violate the provisions of this section is subject to a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties. The parent(s), guardian(s) or legal custodian(s) of a truant who is under thirteen (13)years of age is subject to a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties if the minor, or their parent(s), guardian(s) or legal custodian(s), violate the provisions of this section. SECTION 14: Section 7-11-8: Voluntary Settlements Regarding Certain Violations of the McHenry Municipal Code, shall be amended as follows: 7-11-8: Voluntary Settlements Regarding Certain Violations: Certain offenses may be settled and compromised by payment to the City according to the Fines and Penalties found in Title 15, Chapter 2: Parking Fines. SECTION 15: Section 8-3C-11: Penalty, of the McHenry Municipal Code, shall be amended as follows: 8-3C-11: Penalty: Any person, firm or corporation that violates any provision of this article shall be subject to a fine according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties, plus the City's cost of prosecution, including reasonable attorney fees. Each day that a violation exists and a tree removal permit is not obtained shall constitute a separate offense. Further, a separate offense shall be deemed committed for each tree injured, removed, destroyed or for any undertaking of any procedure,the result of which is to cause the death or substantial destruction of any tree within the City, having a dbh of six inches (6")or greater. SECTION 16: Section 9-2C-4: Reading Meters, Subsection B. Right of Access to Premises, of the McHenry Municipal Code, shall be amended as follows: 9-2C-4: Reading Meters: B. Right Of Access to Premises: The City, its servants, agents and employees shall have a continuing right of access to premises which are served with Municipal water for the purpose of reading water meters and also for the purpose of inspecting, repairing, installing, modifying and replacing water meters. The water supply to any premises may be shut off whenever access has been hindered or denied by the user and/or owner. In addition to such water shutoff, any person, firm or corporation violating this subsection shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, for each day during, or on which such access to the premises has been prevented. SECTION 17: Section 10-2-1: International Building Code; Buildings and Structures, Other than One-or Two-Family Dwellings, Subsections G and H, of the McHenry Municipal Code, shall be amended as follows: 10-2-1: International Building Code; Buildings and Structures, Other Than One- Or Two-Family Dwellings: G. Section 114.4 shall read as follows: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. H. Section 115.3 shall read as follows: Unlawful Continuance: Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 18: Section 10-6-1: Fuel Gas Code Adopted, Subsection H, of the McHenry Municipal Code, shall be amended as follows: 10-6-1: Fuel Gas Code Adopted: H. Delete Section 108.4 Violation penalties and replace with the following: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by a fine according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 19: Section 10-7-1: Mechanical Code Adopted, Subsection G, of the McHenry Municipal Code, shall be amended as follows: 10-7-1: Mechanical Code Adopted: G. Delete Section 108.4, Violation Penalties and replace with the following: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by a fine according to the Fines and Penalties found in Title 15,Chapter 1: Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 20: Section 10-22-7: Administration and Enforcement, Subsection B, of the McHenry Municipal Code, shall be amended as follows: 10-22-7: Administration and Enforcement B. Penalty: Any person found to be in violation of any provision of this chapter shall be guilty of a separate offense for each day or portion thereof during which such violation is committed, continued or permitted, and each offense may be punishable by a fine according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, and the City's reasonable attorney fees. 1. Any person, firm or corporation who alters, repairs, relocates or demolishes by neglect any landmark or any structure within a preservation district without complying with the provisions of this chapter shall be required to restore the structure and its site to its appearance prior to the violation. This civil remedy shall be in addition to and not in lieu of any penalty contained in this section. 2. In the case of an unauthorized demolition of a landmark or a property within a preservation district, the City may choose not to issue a building permit for the subject property for a period of five (5)years after the date of the demolition. SECTION 21: Section 5-5-3: Revocation of License, of the McHenry Municipal Code, shall be amended as follows: 5-5-3: Revocation of License: Any license issued under the provisions of this chapter may be revoked by the City for any violation of any section or regulation hereof, and such revocation shall be in addition to any fine imposed according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties SECTION 22: Section 1-4B-8: Administrative Hearings, Subsection J. Penalties, of the McHenry Municipal Code, shall be amended as follows: 1-4B-8: Administrative Hearings: J. Penalties, Fines Imposed: Upon issuing a determination of liability, the Administrative Law Judge may impose penalties and/or fines that are consistent with applicable provisions of this Code, impose a term of community service, assess costs reasonably related to instituting the administrative adjudication proceeding, if applicable, order the respondent to immediately correct the violation, and impose any other penalties or remedies available at law. Court costs associated with administrative hearings shall be not less than$100.00. SECTION 23: Section 4-2-20: Penalty, of the McHenry Municipal Code, shall be amended as follows: 4-2-20: PENALTY: Any person, firm or corporation violating any provision of this chapter shall be subject to license suspension or revocation, alteration of hours on a temporary or permanent basis and fines of not less than four hundred dollars ($400.00)nor more than two thousand five hundred dollars ($2,500.00) for each offense committed on each day during, or on which, a violation occurs or continues,plus reimbursement of legal fees incurred by the City in the prosecution of Liquor Code violations against the licensee. SECTION 24: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 25: All ordinances, or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict. SECTION 26: This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 27:This ordinance shall be in full force and effect from and after its passage, approval and publication, as provided by law. Passed this 20th day of June, 2022.
