ORDINANCE NO. MC -19-1212
An Ordinance Amending the McHenry Municipal Code with Respect to Water
and Sewer Capital Development Fees
WHEREAS, the City of McHenry desires to maintain a safe and adequate water
supply and distribution system for existing and future residents; and
WHEREAS, an increase in the water capital development fees charged for new
residential development is needed to ensure that adequate funds are available to provide a safe and
adequate water supply and distribution system in the City.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: That Table (A) entitled, "Residential Building Uses" within Section
9-6-2, entitled, "Amount of Fees,"of Chapter 6, Title 9,Public Utilities, of the McHenry City
Code shall be, and is hereby amended and shall hereinafter be read as follows:

McHenry City Code shall be, and is hereby amended and shall hereinafter be read as follows:

SECTION 3: If any section, paragraph, subdivision, clause, sentence, or provision
of this ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such
judgement shall not affect, impair, invalidate or nullify the remainder thereof, which
remainder shall remain and continue in full force and effect.
SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: This ordinance shall be in full force and effect on January 25, 2020,
and shall be published in pamphlet form(which publication is hereby authorized) as provided
by law.
