CITY OF MCHENRY MCHENRY COUNTY STATE OF ILLINOIS ORDINANCE NUMBER ORD-19-1963 An Ordinance Granting Approval of the Final Plat of Subdivision of McCullom Place Lot One Resubdivision in the City of McHenry, McHenry County, Illinois Adopted by the Mayor and City Council Of the City of McHenry McHenry County State of Illinois May 6, 2019 Published in pamphlet form by authority of the Mayor and City Council of the City of McHenry, McHenry County, Illinois this 7'h day of May 2019. ORDINANCE NO ORD-19-1963 AN ORDINANCE GRANTING APPROVAL OF THE FINAL PLAT OF SUBDIVISION OF MCCULLOM PLACE LOT ONE RESUBDIVISION IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, Illiana Realty, LLC, 1331 E Ludlow Ridge Rd., Port Ludlow, WA 98365 ("Owner") is requesting approval of a the Final Plat of Subdivision of McCullom Place Lot One Resubdivision; and WHEREAS, the Planning and Zoning Commission has reviewed the final plat at a public meeting held March 20, 2019 and provided a written record of this meeting and its recommendation to the City Council; and WHEREAS, the City Council finds that the approval of the final plat is in conformance with the Ordinances of the City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That the Final Plat of McCullom Place Lot One Resubdivision prepared by HRGreen dated 8/21/18 with a latest revision date of 3/12/19 is hereby approved subject to the following conditions: • Compliance with all revisions and comments pertaining to site engineering by staff and city engineer. • Plat must be recorded within six months of City Council approval by ordinance and; • A stormwater permit, along with a stormwater pollution prevention plan, shall be submitted and approved by the city engineer and staff prior to construction or any site work being completed. SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form as provided by law.
