AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO ALLOW A
RECREATIONAL INSTITUTION, OUTDOOR AMUSEMENT, RESTAURANT SERVING ALCOHOL,
LIVE ENTERTAINMENT AND DANCING AND OUTDOOR SEATING/WITH ALCOHOL AND
FOOD AT 3002 W ILLINOIS ROUTE 120 IN THE CITY OF MCHENRY, MCHENRY COUNTY,
ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by VFW Post 4600 (aka Veterans Club Inc.), 3002 W
Illinois Route 120, McHenry, IL 60051 ("Applicant"), requesting a Conditional Use Permit to
allow a recreational institution, outdoor amusement, restaurant serving alcohol, live
entertainment and dancing and outdoor seating/with alcohol and food on the property located
on the north side of Illinois Route 120 and east of the Fox River, specifically 3002 W Illinois
Route 120. The property is legally described on Exhibit "A" attached hereto and incorporated
herein, the "SUBJECT PROPERTY"; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on August 15, 2018 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission did recommend to the City Council
the granting of the requested Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the requested Conditional Use
Permit is consistent with the objectives of the City of McHenry Zoning Ordinance to protect the
public health, safety, morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the SUBJECT PROPERTY is hereby granted a conditional use permit to
allow a recreational institution, outdoor amusement, restaurant serving alcohol, live
entertainment and dancing and outdoor seating/with alcohol and food at 3002 W Illinois Route
120 with the following conditions:

• Primary access to/from the outdoor seating area be from the interior of the VFW
building;
• All alcohol consumed outside must remain within the outside seating area delineated on
the plan.
• Regulations in the Outdoor Seating section of the zoning ordinance be followed, with
the exception of the following: "No service of alcohol outside," and "Outdoor seating
must be located on a hard surface such as asphalt concrete, brick or wood."
• Outdoor seating is developed in substantial conformance with the Preliminary Floor
Plan prepared by Reitan Architects LLC and dated 6/28/18.
SECTION 2: In granting said Conditional Use Permit, the City Council finds that the
requirements of Table 31 of the Zoning Ordinance have been met in that:
1. Any adverse impact of types or volumes of traffic flow not otherwise typical in
the zoning district has been minimized.
2. Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light
or air, or other adverse environmental effects of a type or degree not
characteristic of permitted uses in the zoning district, have been appropriately
controlled.
3. The proposed use will fit harmoniously with the existing natural or man-made
character of its surroundings, and with permitted uses in the zoning district. The
use will not have undue deleterious effect on the environmental quality,
property values, or neighborhood character already existing in the area or
normally associated with permitted uses in the district.
4. The proposed use will not require existing community facilities or services to a
degree disproportionate to that normally expected of permitted uses in the
district, nor generate disproportionate demand for new services or facilities, in
such a way as to place undue burdens upon existing development in the area.
5. The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public
in the vicinity.
6. The proposed use is in harmony with all other elements of compatibility
pertinent to the Conditional Use and its particular location.

SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.

AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF MCHENRY, ILLINOIS BY GRANTING
RECLASSIFICATION AND CONDITIONAL USE THEREON.
Whereas, a written Petition signed by the VFW Veteran's Club President of the Board of
Directors, Thomas Lawson, and the City of McHenry has been filed with the City Clerk of the City of
McHenry, Illinois requesting the following zoning change:
I. reclassification from E Estate Zoning District to C5 Highway Commercial District;
2. conditional use permit to allow the following uses on the subject premises: Recreational
Institution; outdoor amusement establishment; restaurant serving alcoholic beverages with
live entertainment and dancing.
under the provisions of the Zoning Ordinance of the City of McHenry, as amended, for the property
commonly known as 3002 West Route 120, McHenry Illinois, and legally described on Exhibit A
attached hereto; and,
Whereas, a hearing was held before the City of McHenry Zoning Board of Appeals on October
23, 1995, at which time the Zoning Board of Appeals did take evidence and view exhibits presented
thereat by the Petitioners; and,
Whereas, based on evidence heard, the Zoning. Board of Appeals found that there was no
overriding reason for not granting the zoning reclassification and conditional use permit as requested;
and,
Whereas, the Zoning Board of Appeals found, and the City Council concurs in that finding, that
it would serve the interests of the City if said reclassification and conditional use permit were granted
for the subject property.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry,
Illinois, as follows:
Section 1: That the following amendments to the City of McHenry Zoning Ordinance are hereby
granted on the property commonly known as 3002 West Route 120, McHenry Illinois 60050, and legally
described in Exhibit A:
A. reclassification from E Estate Zoning, District to C5 Highway Commercial District;
B. conditional use permit to allow the following uses on the subject premises: recreational
Institution; outdoor amusement establishment; restaurant serving alcoholic beverages with
live entertainment and dancing..
Section 2� That the City Council finds that in granting the reclassification, the following criteria
have been proved before this body:
A. The proposed uses are compatible with existing uses or existing zoikg of property in the
environs.

B. The trend of development in the general area since the original zoning of the affected
property was established supports the proposed use or zoning classification.
C. The proposed use or zoning classification is in harmony with the objectives of the
Comprehensive Plan of the City as viewed in light of any changed conditions since the
adoption of the Plan.
D. The proposed use or zoning classification promotes the public interest and not solely the
interest of the applicant.
Section 3: That the City Council finds in granting the conditional use permit, the following
criteria have been proved before this body:

in. The display will not be permitted to be, anchored or secured to the ground, trees,
signs, fire hydrants, or buildings.
t. All products shall be kept flush or parallel, with the face of the building where the
retail business is located and in no case shall the area used for the display exceed
the following dimensions:
a. 20-percent of the width of the business frontage of the building as
defined in the City's Zoning Ordinance.
b. Exceed six -feet in height measured from the sidewalk surface.
e. Be placed more than six -feet from the face of the building.
o. All sales and transfer ofproduct shall take place inside the building where normal
retail transactions occur.
P. Outside display shall only be allowed when weather conditions are favorable for
this use.
q. The display shall be kept neat and orderly and remaifr flee from trash and debris at

r. The display shall be immediately removed by the business owner any time the
City Administrator or his designee, determines a clear sidewalk is needed because
of traffic, street cleaning, maintenance, utility work, crowd control, parade,

Outdoor Seating (MC-15-1-113)
a. Application form for an Outdoor Seating Permit shall be submitted which identifies
business name, address, PIN, zoning designation, name/address/phone/fax/email of
applicant and property owner,
b. A dimensioned site plan indicating the number and location of the tables (including
table measurements), chairs, trash receptacles and any other related elements.
C. A separate "Waiver ofLiability" form signed by file business owner, and in the case
of leased property, the property owner for outside seating on public property, or
alternatively a "Waiver of Liability" provision shall be included on the Outdoor
Seating Permit Application.
d. Once an Outdoor Seating Permit is issued, it shall remain active until such time as
the requesting business ceases to exist. hi other words, it does not have to be
renewed annually. The Outdoor Seating Permit shall include a statement that
authorizes the City to revoke the permit if any of the established conditions are not
met.
e. Establishments with existing outdoor seating and/or with an existing conditional use
permit which addresses outdoor seating, service of food and/or alcohol, outdoor
preparation of food and/or live entertainment and/or dancing may be permitted to
continue to exist however any changes proposed by any of those establishments in the
future will require submittal of an Outdoor Seating Permit application as defined
herein and all conditions included herein shall be met which may include a variance
and/or amendment to an existing ordinance if applicable. (MC-15-1113)
f. Approved ingress and egress to and from a building must be maintained as required
by the City currently adopted building code.
g. Preparation and service of food outside is prohibited.
h. Service and consumption of alcohol outside is prohibited.
i. Outdoor seating must be located on a hard surface such as asphalt, concrete, brick or
wood.
j. Outdoor seating is prohibited within a required landscape island or area.

k. Outdoor seating located adjacent to a vehicular parking area or driving aisle shall be
separated by a physical barrier (fence, gate, landscape planter, etc.)
1. A $25 permit fee shall be required for any establishment seeking an Outdoor Seating
Permit in accordance with the recommended provisions included herein.
In. An inspection shall be required following Outdoor Seating Permitreview andprior to
use of outdoor seating.
ri. Sidewalks shall not be reduced to a clear usable width of less than 48-inches,
o. Pedestrian and motor vehicle vision clearance must not be blocked at intersections,
driveways, doors and signage. This includes the use of appurtenances (umbrellas,
etc.)
P. Tables, chairs and other related items utilized in conjunction with an outdoor seating
area shall be appropriately secured in the case of high winds.
q. Operation of outdoor seating area is only permitted when the business for -'which the
Outdoor Seating Permit was issued is open but in no instance prior to 7:00 AM or
after 10:00 PM. (MC-15-1113)
r. Outdoor seating on public property must be removed during hours that it is not being
utilized.
S. The use of signage, pennants, banners, flags (other than American), lighting, electric
amplification or noise -making devices is prohibited.
t. No electrical appliances or open flame devices shall be located or utilized within the
outdoor seating area however tine use of "infrared -style" heaters is permitted in
accordance with any applicable testing organization (UL) or other listing and in
accordance with the manufacturer's specifications.
Ti. Outdoor seating on public property shall be immediately removed by the business
owner any time the City Administrator or his/her designee, determines that a clear
sidewalk is needed because of traffic, street cleaning, snow or ice removal,
maintenance,, utility work, crowd control, parade, emergency, or in the case of
violation of any of the above conditions included in this section.
L SPACING OF SERVICE STATIONS
No automobile service station shall be Iocated within 600 feet of any other automobile service
station,
S. ADULT BUSINESSES
1. Intent and Purpose: It is the intent of this Section to protect and preserve the health, safety,
welfare and morals of the citizens of the City by regulating adult business within the City.
2. General Standards
A. A separate conditional use permit must be issued for each adult business as defined in
Section XIX herein.
B. Location Restrictions: No adult business shall be operated within 1,000 feet of a
residential zoning district or within 1,000 feet of the property boundaries of any
school, day care center, cemetery, public park, public housing, nursing home, rest
home, sheltered care facility and place ofreligious worship. The distance Iimitation
shall be measured in. a straight Iine from the lot lines of said adult business and
applicable residential zoning district, school, day.care center, cemetery, public park,
public housing, nursing home, nest home, sheltered care facility and place of religious
worship.
C. Only one adult business shall be permitted per block face.

Veterans of Foreign Wars Post 4600 (aka VFW Veterans C1uU Inc.) is plaiming to make
the first significant upgrades to our facilities since 1992. In the first phase of our planning we
would like to build an addition on the South side of the building. This addition will include:
-New lounge area
- New outdoor seating
- Complete remodeling of the bathrooms in our bar
- Installation of a new sprinkler system
- Installation of a new walk in cooler
We plan on beginning this work in the fall of 2018 and look forward to working with the

Table 31 of the City of McHenry Zonning Ordinance provides that in reconunending approval or
conditional approval of a Conditional Use Permit, the Planning and Zoning Commission sball transmit to
the City Council written findings that all of the conditions listed below apply to the requested action.
Please respond to each of these conditions as it relates to your request
1. Traffic
Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning district has
been minimized.
We do not expect any chances to the cturent traffic environnnent
2. Environmental Nuisance
Any adverse effects of noise, glare, odor; dust, waske disposal, blockage of light or air, or other adverse
environmental effects of a type or degree not characteristic of permitted uses in the zoning district have
been appropriately controlled.

The proposed use will fit harmoniously with the existing natural or man-made character of its
surroundings and Nvith permitted uses in the zoning district. The use will not have undue deleterious
effect on the environmental quality, property values, or neighborhood character existing in the area or
