HomeMy WebLinkAboutOrdinances - ORD-15-1739 - 07/06/2015 - VARIANCES DRIVEWAY CUTS 1620 N RIVERSIDE DRORDINANCE NO. 15-1739 AN ORDINANCE GRANTING VARIANCES FROM THE SUBDIVISION CONTROL AND DEVELOPMENT ORDINANCE TECHNICAL SPECIFICATION MANUAL AND STANDARD DETAILS FOR THE PROPERTY LOCATED AT 1620 N RIVERSIDE DRIVE IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, Michael and Mary Chambers ("APPLICANTS" and "OWNERS") have requested variances from the Subdivision Control and Development Ordinance Technical Specifications Manual and Standard Details for the property located at 1620 N Riverside Drive and legally described on attached Exhibit A ("SUBJECT PROPERTY"); and WHEREAS, the Planning and Zoning Commission has reviewed the variances at a public meeting held June 17, 2015 and provided a written record of this meeting and its recommendation to the City Council; and WHEREAS, the City Council finds that the approval of the variances is in conformance with the Ordinances of the City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That the SUBJECT PROEPRTY is hereby granted Variances from Section T - 5.3 Residential Driveways and Parking Lots (F) of the Subdivision Control and Development Ordinance Technical Specifications Manual and Standard Details from the 100' frontage requirement from the 50' separation requirement between two driveways for two driveway cuts for the property located at 1620 N Riverside Drive to allow 75 feet of frontage and 31 feet of spacing between the two driveway cuts with the condition the site is developed in substantial accordance with the conceptual plan prepared on the survey by Luco Construction March 25, 2015 attached hereto and incorporated herein as Exhibit "B". SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form as provided by law. PASSED and APPROVED this 6th day of July 2015.
