Szamlewski, (the "Petitioners"), has been filed with the City Clerk requesting that said territory be annexed to the City of McHenry; and WHEREAS; said territory is not within the corporate limits of any municipality, other than the County of McHenry, and is contiguous to the corporate boundaries of the City of McHenry; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois, specifically 65 ILCS 5/7-1-1, et seq.; and WHEREAS, it is in the best interests of the City of McHenry that said territory be annexed thereto. NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois, as follows: SECTION l: The territory legally described on the attached Exhibit A ("Property) is hereby annexed to the City of McHenry. SECTION 2: Pursuant to Article III -General District Regulations, Section D of the City's Municipal Code, immediately upon annexation, the Property being approximately 5,881 square feet in size is hereby classified RS-4 High -Density Single -Family Residential District. SECTION 3: The City Clerk is directed to record in the Office of the Recorder of Deeds and to file in the Office of the County Clerk of McHenry County, Illinois, and the post office serving the Property within 30 days of the effective date of this Ordinance, a certified copy of this Ordinance, together with a Plat of Annexation of the Property hereby annexed. SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This Ordinance shall be known as Ordinance ORD-15-1723 and shall be in frill force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
