An Ordinance Annexing
Property Commonly Known as
1106 N. River Road, McHenry
IL, 60051 to the City of
McHenry
WHEREAS, a written
petition, signed by the sole
owners of record of all land
within the territory hereinafter
described, being identified as
Michael J. and Maria L. Szamlewski, (the "Petitioners"), has been filed with the City Clerk
requesting that said territory be annexed to the City of McHenry; and
WHEREAS, said territory is not within the corporate limits of any municipality and is
contiguous to the corporate boundaries of the City of McHenry; and
WHEREAS, all petitions, documents and other necessary legal requirements are in full
compliance with the statutes of the State of Illinois, specifically 65 ILCS 5/7- 1 - 1, et seq.; and
WHEREAS, it is in the best interests of the City of McHenry that said territory be
annexed thereto.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF
MCHENRY, McHenry County, Illinois, as follows:
SECTION 1: The following legally described territory (the "Property) is hereby annexed
to the City of McHenry:
Part of Lots 40, 41, 42 Sunnyside described as follows: beginning at the N.W. comer of
Lot 42, thence East along North line of Lot 42 51.5 feet, thence South 77 feet, thence
West 265.9 feet to the N.E. line of Fox River Road, thence N.W. 161 feet along said N.E.
line of Fox River Road to N.W. comer of Lot 40, thence East along North line 358 feet to
the P.O.B., according to the plat thereof recorded September 17, 1909 as 13880, Book 3
of plats, page 34, in McHenry County, Illinois, PIN 09-35-226-001.
SECTION 2: Pursuant to Article 111-General District Regulations, Section D of the City's
Zoning Ordinance and Section 17-4 Zoning for newly annexed territory in the Municipal Code,
immediately upon annexation, the Subject Property being approximately 26,849 square feet in
size is hereby classified RS I -A Medium -Low Density Single -Family Residential District.
SECTION 3: The City Clerk is directed to record in the Office of the Recorder of Deeds and to
file in the Office of the County Clerk of McHenry County, Illinois, and the post office serving
the Property within 30 days of the effective date of this Ordinance, a certified copy of this
Ordinance, together with a Plat of Annexation of the Property hereby annexed.
SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in fall force and effect.
SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: This Ordinance shall be known as Ordinance ORD-14-1686 and shall be in
full force and effect upon its passage, approval and publication in pamphlet form (which
publication is hereby authorized) as provided by law.

1, DOUG MARTIN, do hereby certify that I am the duly appointed, acting and qualified
Deputy City Administrator of the City of McHenry, McHenry County, Illinois, and I do hereby
further certify that at a regular meeting of the McHenry City Council, held on the 8th day of
September, 2014, the foregoing Ordinance entitledAn Ordinance Annexing Property Commonly
Known as 1106 N. River Rd. to the City ofMcHenry, was duly passed by said City Council.
The pamphlet form of Ordinance No. ORD- 14-16 8 6 , including the Ordinance and a cover
sheet thereof, was prepared, and a copy of such Ordinance was posted in the City Hall, com-
mencing on the 8th day of Septemb , 2014, and will continue for at least 10 days thereafter.
Copies of such Ordinance are also available for public inspection upon request in the office of
the City Clerk.
I do further certify that the original, of which the attached is a true and correct copy, is
entrusted to me as the Deputy City Administrator of said City for safekeeping, and that I am the
lawful custodian and keeper of the same.

PETITION FOR ANNEXATION
TO THE CITY OF McHENRY
To: Mayor and Aldermen, City of McHenry
McHenry County, Illinois
Date: August 19, 2014
The undersigned Petitioners seek annexation of the following property to the City of McHenry,
pursuant to 65 ILCS 5/7-1-8. In support thereof Petitioners, being first duly sworn -under oath,
verify the following to be true and correct and state as follows:
1) That they are the owners of the parcels constituting the property to be annexed,
which is commonly known as 1106 N. River Road, McHenry IL, 60051 ("Territory");
2) The Territory is legally described as follows:
Part of Lots 40, 41, 42 Sunnyside described as follows: beginning at the N.W. corner of
Lot 42, thence East along North line of Lot 42 51.5 feet, thence South 77 feet, thence
West 265.9 feet to the N.E. line of Fox River Road, thence N.W. 161 feet along said N.E.
line of Fox River Road to N.W. corner of Lot 40, thence East along North line 358 feet to
the P.O.B., according to the plat thereof recorded September 17, 1909 as 13880, Book 3
of plats, page 34, in McHenry County, Illinois, PIN 09-35-226-001; and commonly
known as 1106 N. River Road.
3) Petitioners constitute 100% of the owners of record of all of the property within
the Territory proposed to be annexed;
4) Petitioners constitute all electors residing within the Territory;
5) The Territory is not within the corporate limits of any municipality, and is
currently under the jurisdiction of and located within McHenry County; and
6) The Territory is continuous to the current corporate limits of the City of
McHenry.
Wherefore, Petitioners respectftilly request that the Territory be annexed to the City of McHenry
and for such other action is taken that is appropriate for the Territory.
