ORDINANCE NO. ORD-14-1681
AN ORDINANCE GRANTING APPROVAL OF THE FINAL PLAT OF JUSTEN FUNERAL HOME
SUBDIVISION IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, Bear Development, (referred to as the "DEVELOPER") has requested approval
of the Preliminary Plat of Subdivision and Final Plat of Justen Funeral Home Subdivision; and
WHEREAS, the Planning and Zoning Commission has reviewed the preliminary and final
plat at a public meeting held April 17, 2014 and provided a written record of this meeting and its
recommendation to the City Council; and
WHEREAS, the City Council finds that the approval of the preliminary and final plat is in
conformance with the Ordinances of the City.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry
County, Illinois, as follows:
SECTION 1: That the Final Plat of Justen Funeral Home Subdivision attached hereto and
incorporated herein by reference, shall be and the same is hereby approved, with the following
conditions:
• Compliance with comments by the city engineer and;
• Plat is recorded within six months of City Council approval by ordinance and;
• Stormwater maintenance agreement be submitted and recorded against the
property contemporaneously with the recordation of the final plat of subdivision
and;
• Allow full access off Municipal Drive to the petitioner beginning today to be
converted to right in/right out within five (5) years of completion of Knox Drive, or
prior to receipt of a certificate of occupancy for a second building whichever occurs
first, at which time the full access onto Municipal Drive would be converted to right

• Addition of lot width and building setback lines consistent with the zoning district
requirements on the subject property.
SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval
and publication in pamphlet form as provided by law.

12. Third Party Beneficiaries. The Parties do notlwwnd to directly or substantially benefit a

beneficiaries to this Agreement and that no third parry shall he entitled to assert a claim

13. Waiver of Breach. Failure by either party to enforce any provision of this Agreement
shall not be deemed a waiver of such provision or modification ofthis Agreement A

any subsequent breach and shall not be construed to be a modification of the terras of tMs
Agreement
