AN ORDINANCE GRANTING VARIANCES FROM THE SUBDIVISION CONTROL AND DEVELOPMENT
ORDINANCE TECHNICAL SPECIFICATION MANUAL AND STANDARD DETAILS SECTIONS T - 5.3
RESIDENTIAL DRIVEWAYS AND PARKING LOTS (F) AND T - 5.3 RESIDENTIAL DRIVEWAYS AND
PARKING LOTS (F) (I) FOR THE PROPERTY LOCATED AT 3214 GOLFVIEW TERRACE IN THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, Jamie and Jeff Grubich (referred to as the "OWNERS") have requested
variances from the Subdivision Control and Development Ordinance Technical Specifications
Manual and Standard Details for the property located at 3214 Golfview Terrace and legally
described on attached Exhibit A ("SUBJECT PROPERTY"); and
WHEREAS, the Planning and Zoning Commission has reviewed the variances at a public
meeting held January 16, 2014 and provided a written record of this meeting and its
recommendation to the City Council; and
WHEREAS, the City Council finds that the approval of the variances is in conformance
with the Ordinances of the City.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry
County, Illinois, as follows:
SECTION 1: That the following variances from Sections T - 5.3 Residential Driveways
and Parking Lots (F) and T - 5.3 Residential Driveways and Parking Lots (F) (i) of the Subdivision
Control and Development Ordinance Technical Specifications Manual and Standard Details shall
be and the same are hereby approved.
1. Variance to allow three driveways on the SUBJECT PROPERTY;
2. Variance from the required 50-foot separation requirement between two driveways
to no less than 30 feet.

SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval
and publication in pamphlet form as provided by law.
