NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF McHENRY, McHenry County, Illinois, as follows: SECTION 1: Chapter 21, Streets and Sidewalks, shall be amended to add an Article VIII, Prevailing Wage Rates, as follows: ARTICLE VIII PREVAILING WAGE RATES Sec. 21-121. Wage Rates on Public Works Projects. To the extent and as required by the Illinois Prevailing Wage Act, 820 ILCS 130.1, et. seq., the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in construction of public works coming under the jurisdiction of the City of McHenry is hereby ascertained to be the same as the prevailing rate of wages for construction work in the McHenry County area as determined by the Illinois Department of Labor, at the time of the construction of the public work, which determination can be found at https:llwww.illinois.govlidol/Laws-RulesICONMED/Pagesl2017-Rates.aspx and which is incorporated herein by reference. The Department of Labor revises the prevailing wage rates and all City contractors/subcontractors shall have an obligation to check the Department's web site for revisions to prevailing wage rates. All contractors and subcontractors rendering services to the City must comply with all requirements of the Illinois Prevailing Wage Act, including but not limited to, all wage requirements and notice and record keeping duties. The Clerk shall mail a copy of this determination to any employer, and to any association of employers and to any person or association of employees who have filed their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates. The Clerk shall promptly file a certified copy of this Ordinance with the Illinois Department of Labor in Springfield. Prevailing Wage Rates, Page 1 D� aft July S, 2018 A copy of this prevailing wage requirement shall be attached to all contract specifications. The Clerk shall cause to be posted on the City's website the notice of passage of this Ordinance, with a hyperlink to the relevant prevailing wage schedule published on the official website of the Department of Labor, and such posting shall constitute notice that the determination is effective and that this is the determination of this public body. SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 3 : All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
