ORDINANCE NO. ORD-12-1608
AN ORDINANCE GRANTING APPROVAL OF THE FINAL PLAT OF THE SHOPS AT FOX RIVER
RESUBDIVISION IN THE CITY OF MCHENRY, IMCHENRY COUNTY, ILLINOIS
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, Developers Diversified, represented by Woolpert, Inc. (referred to as the
"OWNER") has requested approval of the Preliminary Plat of Subdivision and Final Plat of The
Shops at Fox River Resubdivision; and
WHEREAS, the Planning and Zoning Commission has reviewed the preliminary and final
plat at a public meeting held September 20, 2012 and provided a written record of this meeting
and its recommendation to the City Council; and
WHEREAS, the City Council finds that the approval of the preliminary and final plat is in
conformance with the Ordinances of the City.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry
County, Illinois, as follows:
SECTION 1: That the Final Plat of the Shops at Fox River Resubdivision prepared by
Woolpert, Inc. and bearing the date 8/24/2012 with a latest revision date of 9/7/12, attached
hereto and incorporated herein by reference, shall be and the same is hereby approved, with
the following conditions:
• Compliance with all revisions to the original engineering plans as reviewed by the city
engineer;
• Plat is recorded within six months of City Council approval by ordinance and;
• Any existing covenants for The Shops at Fox River Subdivision be amended to reflect the
resubdivision;
• A storm water permit, along with a storm water pollution prevention plan, shall be
submitted and approved by the city engineer prior to construction.

SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval
and publication in pamphlet form as provided by law.
