HomeMy WebLinkAboutOrdinances - ORD-11-1549 - 08/29/2011 - APPROVE PRELIM AND FINAL PLAT PANDA EXPRESSORDINANCE NO ORD-] 1-1549 AN ORDINANCE GRANTING APPROVAL OF THE PRELIMINARY AND FINAL PLAT OF SUBDIVISION FOR LOT I OF THE RESUBDIVISION OF LOT 1 IN RUBLOFF TOWNE CENTRE IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, Panda Restaurant Group Inc. (referred to as the "OWNER") has requested approval of the Preliminary and Final Plat of Subdivision for Lot 1 A of the Resubdivision of Lot I in Rubloff Towne Centre; and WHEREAS, the Planning and Zoning Commission has reviewed the preliminary and final plat at a public meeting held June 30, 2011 and provided a written record of this meeting and its recommendation to the City Council; and WHEREAS, the City Council finds that the approval of the preliminary and final plat is in conformance with the Ordinances of the City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That the preliminary and final plat entitled, "Lot I A of the Resubdivision of Lot I in Rubloff Towne Centre," prepared by Sherrill Associates and bearing the date 6/3/201 I, attached hereto and incorporated herein by reference, shall be and the same is hereby approved, with the conditions: 1 . Approval shall be contingent upon Council approval of the conditional use pen -nit for a restaurant with a drive-thru facility for the subject property; 2. Compliance with all revisions to the engineering plans and final plat as recommended by the City engineer; 3. The final plat shall be recorded within six months of Council approval; 4. Any existing covenants to the Rubloff Towne Centre Subdivision shall be amended to include Lot 1 A; 5. Storm water permit application shall be submitted and best management practices shall be used whenever and wherever appropriate, as recommended by City engineer in order to reduce/filter runoff into the detention areas; 6. All existing conditions included on the recorded final plat of Rubloff Towne Center subdivision shall remain in full force and effect for the newly created Lot IA. SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval and publication in pamphlet form as provided by law. Passed and approved this 29"' day of August, 2011.
