HomeMy WebLinkAboutOrdinances - ORD-11-1531 - 03/21/2011 - AUTHORIZE INT AGMT MHSD 156 WEST CAMPUS TENNIS COUOrdinance No. ORD-11- 1531 An Ordinance Authorizing the Execution of an Intergovernmental Agreement between the City of McHenry and McHenry High School District 156 for improvement and shared use of the West Campus tennis courts WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, as follows: SECTION 1: The Mayor and City Council of the City of McHenry find that an Intergovernmental Agreement to provide for the improvement and shared use of the McHenry High School District 156 West Campus tennis courts is in the best interest in the residents of the City of McHenry. SECTION 2: The Mayor is hereby authorized to execute an Intergovernmental Agreement between the City of McHenry and McHenry High School District 156, hereby attached as Exhibit A, for the purpose of improving the tennis courts at West Campus and providing for shared use of those facilities. PETERSON , CONDON Voting Nay: SCHAEFER Not Voting: _ NONE Abstained: NONE Absent: Mayor ATTEST: City Clerk TENNIS COURT SHARED USE AGREEMENT McHenry Community High School District 156 & City of McHenry This Agreement ("Agreement") is entered into this/ °l� day of A&ILcA 20_((, by and between the City of McHenry, an Illinois municipal corporation ("City") and McHenry Community High School District 156, a unit of local government ("District 156"), (collectively, the "Parties"). Renovation and Maintenance 1. McHenry Community High School District 156 shall competitively bid the construction of improvements to the Tennis Courts at West Campus. 2. Prior to commencement of the Construction Improvements, The City of McHenry will contribute $20,000 to the McHenry Community High School District 156 as its contribution towards renovation costs. 3. Court maintenance and upkeep will be the responsibility of McHenry District 156. Field Use 4. During the Illinois High School Association ("IHSA") boys and girls tennis seasons (See Below IHSA 5-Year Calendar), through and including any postseason play ("IHSA Season"), District 156 shall have first priority over the Court's use and District 156 shall retain priority over all other potential users. 5. The courts will be available for community use (Open Play), by both, individuals and the McHenry Park and Recreation Department: a. On week days, weekends and holidays during the school year when no high school tennis practice, match or competition is scheduled. Matches are typically finished by 6:30 PM during the school year. "Open Play" will be available to the community from the completion of matches until the lights are turned off at 10:00 PM. The high school will provide the city with the schedules for boys and girls tennis each year. (See IHSA Tennis 5-Year Calendar below d.) b. "Open Play" will be available to the community when school is not in session during spring break, summer vacation, and when the high school tennis teams are not in season. Spring Break is traditionally the last week of March. Open play will be available when the boy's tennis team is not practicing. The high school will notify the city as to the boy's spring break tennis schedule each year. (See IHSA Tennis 5-Year Calendar below d.) C. High School tennis camps, during summer break, will take tennis court president. McHenry Park and Recreation Department will be notified by the high school of summer tennis camp dates and times. d. The boys and girls high school tennis seasons are listed below in accordance with the IHSA. State Final (Thurs.-Sat.) Season Ends (Sat.) 6. Tennis court lights will be set on a timer to provide court illumination from dusk until 10:00 PM starting April 15"' through October 3 1 ". 7. Scheduling of the tennis will be the responsibility of the high school director of athletics. Requests for use by the McHenry Parks and Recreation Department will be submitted to the high school in the same manner as the scheduling of the pool and gym facilities are currently submitted, such as, volleyball leagues and swimming. General Terms and Conditions 8. Liability Agreement as per Shared use Agreement Ordinance No. Mc-80-179, #3 and #8. (See Attached) Or, such insurance shall provide coverage in an amount not less than $5,000,000 for bodily injury to one or more persons and in an amount of not less than $5,000,000 for property damage, as per Petersen Park Intergovernmental Agreement, Terms and Conditions #12. (See Attached) 9. This Agreement shall be for a term of 10 years, commencing with the execution of this Agreement, and shall automatically extend for terms of five years, unless either party serves written notice on the other party of its intent to cancel at least 30 days prior to the end of the then -current term.
