An Ordinance Authorizing the Disposal of
Surplus Parks and Recreation Surplus Property
Owned by the City of McHenry
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the
State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's
home rule powers and functions as granted in the Constitution of the State of Illinois; and
WHEREAS, in the opinion of the corporate authorities of the City of McHenry, it
is no longer necessary or useful to or for the best interests of the City of McHenry to
retain ownership of the property identified and described on Exhibit A attached hereto
and made a part hereof, and
WHEREAS, it has been determined by the Mayor and City Council of the City of
McHenry to dispose of said surplus Parks and Recreation Property by means of public
garage sale.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF MCHENRY AS FOLLOWS:
SECTION 1: The Mayor and City Council of the City of McHenry find that the
property described on Exhibit A attached hereto and made a part hereof is no longer
necessary to the function of said jurisdiction.
SECTION 2: The Mayor and City Council direct, by a minimum of three-
quarters majority, that the City Administrator is hereby authorized and directed to dispose
of said property in the manner stated.
SECTION 3: This ordinance shall be in full force and effect from and after its
passage by the corporate authorities.
PASSED and APPROVED this 15"' day of February, 2010.
