AN ORDINANCE GRANTING A ZONING MAP AMENDMENT TO THE
PROPERTY LOCATED AT 3320 BULL VALLEY ROAD
IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the City requesting a zoning map amendment to RM-2,
High -Density Multi -Family Residential for the approximately 1.97 acres located at 3320 Bull Valley
Road, described and depicted on Exhibit A attached hereto and incorporated herein by reference; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on February 19, 2009, in the manner prescribed by ordinance and statute; and
WHEREAS, the City Council has considered the evidence and finds that the approval of the
zoning change currently requested and approved by this ordinance is consistent with the objectives of the
City of McHenry Zoning Ordinance to protect the public health, safety, morals and general welfare of its
residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the property located at 3320 Bull Valley Road and commonly described and
depicted on Exhibit .A, attached hereto and incorporated herein by reference, be granted a Zoning Map
Amendment to RM-2. High -Density Multi -Family Residential.
SECTION 2.: In granting said Zoning Map Amendment, the City Council finds that the
requirements of Table 33 of the Zoning Ordinance have been met in that:
The requested zoning classification is compatible with the existing uses and zoning of
property in the environs;
2. The requested zoning classification is supported by the trend of development in the general
area;
3. The requested zoning classification is consistent with the objectives of the City of McHenry
Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 4_ This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval,
and publication in pamphlet form as provided by law.

That part of the west half of the northwest quarter of Section 2, township 44 North, Range 8, east of the
third principal meridian, described as follows: Commencing at the southeast corner of said west half;
thence west along the south line of said northeast quarter, 132.0 feet for a point of beginning; thence
west along said south line 263,5 feet; thence north parallel with the east line of said west half 330.0
feet; thence east parallel with the south line of said northeast quarter, 263.5 feet; thence south parallel
with the east line of said west half, 330.0 feet to the point of beginning. Excepting that part of the west
half of the northeast quarter of Section 2, Township 44 North, Range 8 east of the third principal
meridian described as follows: Commencing at the southeast corner of said northeast quarter, thence
south 89 degrees 26 minutes 53 seconds west (bearings assumed for description purposes only) along
the south line thereof, 1696.57 feet to a line, 395.5 feet west of (measured along said south line) and
parallel with the east line of said west half of the northeast quarter; thence north 00 degrees 48 minutes
17 seconds east along a parallel line, 305.09 feet to the point of beginning; thence continuing north 00
degrees 48 minutes 17 seconds east, 25 feet; thence north 89 degrees 26 minutes 53 seconds east, a
distance of 100.00 feet, thence southwesterly on a direct and straight line, 103.65 feet to the point of
beginning, in McHenry County, Illinois.
