Ordinance repealing City of McHenry
Ordinance Number ORD-07-1380 dated 4/23/2007
granting zoning and conditional use permit to
Curtis Commercial Inc., for the property located at 1110 North Green Street.
WHEREAS, the McHenry City Council at its regularly scheduled meeting held on April 23, 2007 considered a
request from the Applicant, Curtis Commercial, Inc., for Zoning Map Amendment from 0-1 Local Office to C-4
Downtown Commercial District, and a Conditional Use Permit for expanded Site Plan Review in the Downtown
Overlay District to allow a 4-story mixed -use building at 1110 North Green Street; and
WHEREAS, the McHenry City Council on April 23, 2007 approved an ordinance known as ORD-07-1380 granting
the requested zoning relief to the Applicant; and
WHEREAS, it was determined following presentation to City Council that required notification requirements had
not been met prior to holding the Public Hearing before the Planning and Zoning Commission on April 5, 2007, at
which time and place testimony was taken regarding the zoning relief requested; and
WHEREAS, as the testimony taken at the Planning and Zoning Commission on April 5, 2007 was considered null
and void and the approved ordinance number ORD-07-1380 was passed and approved without benefit of a
Public Hearing.
NOW THEREFORE, BE IT KNOWN THAT City of McHenry Ordinance Number ORD-07-1380 is hereby repealed in
its entirety.
