An Ordinance Authorizing the Sale of Property
WHEREAS, the City of McHenry, McHenry County, Illinois, is the owner of certain real
estate commonly known as 1110 N Green Street, Vacant Land consisting of approximately,
1.049 acres, McHenry, Illinois legally described as follows:
That part of the Southeast quarter of Section 26, Township 45 North, Range 8, East of the
Third Principal Meridian; and;
Part of the Southeast Quarter of Section 26, and part of the Northeast Quarter of Section
35, Township 45 North, Range 8, East of the Third Principal Meridian; and;
That part of Lot 1, in Block 2 in Venice Park Addition to McHenry, Unit No. 1, a
Subdivision of part of the Southeast Fractional Quarter of 26, and part of the Northeast
Fractional Quarter of Section 35, Township 45 North, Range 8, East of the Third
Principal Meridian, according to the Plat thereof, recorded February 25, 1941, as
Document No. 152920, in Book 7 of Plats, page 68.
("Green Street Parcel")
WHEREAS, the City of McHenry, McHenry County, Illinois, is also the owner of
another vacant parcel of real estate consisting of approximately .05 acres immediately adjacent to
the Green Street parcel legally described as follows:
That part of Lot 1 in Block 2 in Venice Park addition to McHenry, Unit No. 1, a
subdivision of part of the southeast quarter of Section 26 and part of the northeast quarter
of Section 35, all in Township 45 North, Range 8 east of the third principal meridian,
according the plat thereof recorded February 25, 1941 as document No. 152920, in Book
7 of plats, page 68.
("Adjacent Vacant Parcel")
WHEREAS, the Green Street Parcel and the Adjacent Vacant Parcel, collectively
referred to as the "Property," are generally located south of Boone Lagoon at the northeast corner
of Green Street and Waukegan Road and total approximately 1.099 acres, in McHenry, Illinois.
WHEREAS, the Property is currently vacant, located within the downtown McHenry Tax
Increment Redevelopment Project Area Financing District and the City desires to dispose of the
Property, subject to it being developed pursuant to the terms of a Redevelopment Agreement,
attached hereto and pursuant to bids received after due advertisement and pursuant to the
authority provided in 65 ILCS 5/11-74.4-4(c) and 65 ILCS 5/11-76-2.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Aldermen of the CITY OF
McHENRY, McHenry County, Illinois, as follows:
SECTION 1: Pursuant to 65 ILCS 5/74.4-4(c) and 65 ILCS 5/11-76-2, the City hereby
directs the salt; of the Property by competitive bid. All bids shall include a fully executed
Redevelopment Agreement attached hereto. Provided, however, pursuant to 65 ILCS 5/11-74.4-
4 (c), alternative proposals and bids will be received and considered. All bidders must possess
the following minimum qualifications:
1. Have a principal with at least 25 years of experience in the real
estate industry;
2. Have a principal with at least 10 years of experience developing
residential and/or commercial projects;
3. Have the financial capacity to undertake a development project
with a total budget the size of this Project;
4. Have a principal that has been involved with at least two projects
that have received past TIF assistance in Illinois; and
5. Be capable of dedicating a full-time superintendent to the Project.
The City reserves the right to reject any and all bids.
SECTION 2: The following notice shall be published once each week for three (3)
successive weeks in the Northwest Herald with the first publication not less than thirty (30) days
before the opening of bids for the Property:

Sale of TIF Property
NOTICE is hereby given that the City of McHenry, McHenry County,
Illinois, is disposing of two parcels of land adjacent to each other generally
located south of Boone Lagoon at the northeast corner of Green Street and
Waukegan Road and total approximately 1.099 acres. The following are the legal
descriptions of each parcel being offered for sale by sealed bids:
That part of the Southeast quarter of Section 26, Township 45 North, Range 8, East of the
Third Principal Meridian; and;
Part of the Southeast Quarter of Section 26, and part of the Northeast Quarter of Section
.35, Township 45 North, Range 8, East of the Third Principal Meridian; and;
That part of Lot 1, in Block 2 in Venice Park Addition to McHenry, Unit No. 1, a
Subdivision of part of the Southeast Fractional Quarter of 26, and part of the Northeast
Fractional Quarter of Section 35, Township 45 North, Range 8, East of the Third
Principal Meridian, according to the Plat thereof, recorded February 25, 1941, as

7 of plats, page 68, consisting of approximately .05 acres.
Sealed bids for the property as a whole, including an executed
Redevelopment Agreement referencing "Bid for TIF Property, McHenry, Illinois"
must be delivered to the City Clerk of the City of McHenry, 333 S. Green Street,
McHenry, Illinois, before 4 p.m. on March 5, 2007. All bids received shall be
opened at the regular City Council meeting on March 5, 2007, at 7:30 p.m. in the
City Council Chambers, 333 S. Green Street, McHenry, Illinois. The form of the
Redevelopment Agreement to be included with all sealed bids is available from
the City Administrator at the City Hall. All bidders must possess the following
minimum qualifications:

The Corporate Authorities of the City of McHenry reserve the right to accept the
high bid or any other bid determined to be in the best interest of the City and the
right to reject any and all bids.

SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect,, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 5: This Ordinance shall be in full force and effect upon its passage, approval
and publication in pamphlet form (which publication is hereby authorized) as provided by law.
