AN ORDINANCE GRANTING A ZONING MAP AMENDMENT AND
FOR THE TOWNHOMES OF PRAIRIE LAKES DEVELOPMENT
LOCATED ON THE SOUTH SIDE OF BULL VALLEY ROAD,
IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed by SW McHenry, LLC, hereinafter referred to as the
"OWNER", requesting a Zoning Map Amendment to RM-2, High Density Multi -Family Residential for the
property legally described on "Exhibit A", attached hereto and incorporated herein; the "SUBJECT
PROPERTY"; and
WHEREAS, a public hearing on said petitions was held before the Planning and Zoning Commission
on August 18, 2005, in the manner prescribed by ordinance and statute; and
WHEREAS, as a result of said hearing, the Planning and Zoning Commission did recommend to the
City Council the granting of the requested Zoning Map Amendment; and
WHEREAS, the City Council has considered the evidence and recommendations from the Planning
and Zoning Commission and finds that the approval of the requested Zoning Map Amendment and are
consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health, safety,
morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the SUBJECT PROPERTY be granted a Zoning Map Amendment to RM-2, High
Density Multi -Family Residential.
SECTION 2: In granting said Zoning Map Amendment, the City Council finds that the requirements
of Table 33 of the Zoning Ordinance have been met in that:
The requested zoning classification is compatible with the existing uses and zoning of
property in the environs;
2. The requested zoning classification is supported by the trend of development in the general
area;
The requested zoning classification is consistent with the objectives of the City of McHenry
Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the
corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 7: This Ordinance shall be in full force and effect from and after its passage, approval,
and publication in pamphlet form as provided by law.

Legal Description of the SUBJECT PROPERTY
That part of the North Half of the Southwest Quarter of Section 3, Township 44 North, Range 8 East of the
Third Principal Meridian, described as follows: Beginning at point on the North line of the Southwest
Quarter of said Section 3, said point being 264.0 feet East of the Northwest corner thereof; thence North 89
degrees 18 minutes 22 seconds East along the North line thereof, 389.56 feet to the Southwest comer of
Kresswood Trails Phase 2 according to the Plat thereof recorded December 20, 2002 as Document
2002R0122070; thence South 00 degrees 41 minutes 27 seconds East, 100.00 feet to the South line of Bull
Valley Road; thence North 89 degrees 18 minutes 22 seconds East along said South line, 1,057.54 feet to the
westerly right-of-way line of the Chicago and Northwestern Railroad; thence South 29 degrees 14 minutes 27
seconds West along said westerly right-of-way line, 1,405.85 feet to the South line of the North Half of the
Southwest Quarter of said Section 3; thence South 89 degrees 19 minutes 07 seconds West along said South
line, 771.59 feet to the East line of the West 264.0 feet of said Southwest Quarter; thence North 00 degrees
26 minutes 14 seconds East along said West line, 1,318.40 feet to the Place of Beginning in McHenry
County, Illinois.
