HomeMy WebLinkAboutOrdinances - ORD-04-1240 - 11/29/2004 - ANEX LOT 16 BLOCK 3 HUNTERVILLE PARKORDINANCE NO. 0RD-04-1240 An Ordinance Annexing Lot 16 in Block 3 Of the Hunterville Park Subdivision to the City of McHenry WHEREAS, Section 7-1-13 of the Illinois Municipal Code, 65 ILCS 5/7-1-13, permits municipalities to annex unincorporated territory containing 60 acres or less that is wholly bounded by one or more municipalities; and WHEREAS, the following legally described territory (the "Territory") is less than 60 acres and is wholly bounded by the City of McHenry, an Illinois municipal corporation located in McHenry County (the "City"): Lot 16 of Block 3 in Hunterville Park Subdivision being a Subdivision of the Southeast Quarter of Section 26 and the Southwest Quarter of Section 25 in Township 45 North, Range 8 East of the Third Principal Meridian in McHenry County, Illinois. WHEREAS, the Territory consists of the following parcel of property: PIN 09-25-305-003 with a common address of 3011 Mourine Drive, McHenry, Illinois 60050 On information and belief, the owners of record of said parcel of land to which property number (09-25-305-003) is assigned are Ralph Antti and Grace Antti; and WHEREAS, all required notices have been duly sent and published as required by law. WHEREAS, it is in the best interests of the City that said Territory be annexed thereto. NOW, THEREFORE, BE IT ORDAINED, by the Acting Mayor and Aldermen of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That the Territory, as legally and commonly described above, is hereby annexed to the City of McHenry, McHenry County, Illinois. SECTION 2: The City Clerk is directed to file a certified copy of this Ordinance and an accurate map of the Territory with the McHenry County Clerk and to record a certified copy of this Ordinance and a ma of the Territory in the office of the McHenry County Recorder of Deeds.A- SECTION 3: The zoning map of the City shall note that the annexed territory is zoned Hunterville, Lot 16, Page 1 "RS-4, High -Density Single -Family Residential District". SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
