AN ORDINANCE APPROVING CERTAIN VARIANCES FROM THE CITY OF MCHENRY ZONING
ORDINANCE AND SUBDIVISION CONTROL AND DEVELOPMENT ORDINANCE AND THE FINAL
PLAT OF SHAMROCK FARMS SUBDIVISION NEIGHBORHOOD 5, IN THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, Kimball Hill Homes, (the "DEVELOPER') has requested approval of a variance from the
City of McHenry (the "CITY") Zoning Ordinance for lot width, approval of a variance from the City of McHenry
Subdivision Control and Development Ordinance for the length of a cul-de-sac and approval of the Final Plat of
Subdivision for Shamrock Farms Subdivision Neighborhood 5; and
WHEREAS, the Planning and Zoning Commission has reviewed the proposed variances and final plat at a
public meeting held January 15, 2004 and provided a written record of this meeting and its recommendation to the
City Council; and
WHEREAS, the City Council finds that the approval of the variances and final plat is in conformance with
the Ordinances of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That a Variance from the CITY'S Zoning Ordinance for Lot Width is hereby granted for Lot
46 and in Shamrock Farms Subdivision Neighborhood 5 and a Variance from the City's Subdivision Control and
Development Ordinance for the length of a cul-de-sac for Wexford Court are hereby granted to allow the
development of Shamrock Farms Subdivision Neighborhood 5 in conformance with the approved final plat
referenced below.
SECTION 2: That the final plat entitled "FINAL PLAT SHAMROCK FARMS SUBDIVISION -
NEIGHBORHOOD 5", prepared by Manhard Consulting Ltd. dated 8/26/02 and bearing a latest revision date of
6/25/04 attached hereto and incorporated herein by reference, be and the same is hereby approved with the condition
that the fipj plat shall be recorded within six (6) months of City Council approval.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby
repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the
corporate authorities of the City of McHenry, McHenry County, Illinois.

SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval, and
publication in pamphlet form as provided by law.
