AN ORDINANCE APPROVING CERTAIN VARIANCES FROM THE CITY OF MCHENRY
SUBDIVISION CONTROL AND DEVELOPMENT ORDINANCE AND THE FINAL PLAT
OF EVERGREEN PARK SUBDIVISION, IN THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, Centex Homes, (the "DEVELOPER") has requested approval of certain variances from the
City of McHenry (the "CITY") Subdivision Control and Development Ordinance and the Final Plat of Subdivision
for Evergreen Park Subdivision; and
WHEREAS, the Planning and "Zoning Commission has reviewed the proposed variances and final plat at a
public meeting held July 1, 2004 and provided a written record of this meeting and its recommendation to the City
Council; and
WHEREAS, the City Council finds that the approval of the variances and final plat is in conformance with
the Ordinances of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That Variances from the following provisions in the CITY'S Subdivision Control and
Development Ordinances are hereby granted to allow the development of Evergreen Park Subdivision in
conformance with the approved final engineering plans prepared by Jacob & Hefner Associates, P.C. dated 3/19/04
and bearing a latest revision date of 6/25/04 and any subsequent revisions prior to construction as required by the
CITY.
Buildings are to be located no less than seventy-five (75) feet from detention basins.
The bottom slope of the detention ponds shall not be less than two percent (2%).
The inverts of the storm sewers of differing diameters are to match at 0.8 depth points.
The minimum diameter of underdrains is ten (10) inches.
Storm sewer shall be reinforced concrete pipe (RCP).
SECTION 2: That the final plat entitled "FINAL PLAT OF SUBDIVISION OF EVERGREEN PARK",
prepared by Jacob & Hefner Associates, P.C. dated 5/13/04 and bearing a latest revision date of 7/8/04 attached
hereto and incorporated herein by reference, be and the same is hereby approved with the following conditions:
1. The DEVELOPER shall submit a Plat of Easement for the perpetual maintenance of
landscaping and fencing, in the Blake Boulevard right-of-way, to be executed by the
CITY, prior to the issuance of a building permit.
2. Landscaping for Evergreen Park Subdivision shall be in conformance with the Landscape
Improvement Plans prepared by Hitchcock Design Group dated 5/27/04 and bearing a
latest revision date of 8/26/04(A -f-rAC 4(D A,. fxHt blf A )
3. The final plat shall be recorded within six (6) months of City Council approval.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby
repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the
corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval, and
publication in pamphlet form as provided by law.
