ORDINANCE NO. ORD-04-1216
AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE
OPERATION OF A MOTOR VEHICLE REPAIR SHOP AT 913 N. FRONT ST. IN THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the City by Ernesto Baggio requesting a Conditional
Use Permit to allow the operation of a motor vehicle repair shop at 913 N. Front St., the "SUBJECT
PROPERTY", legally described on Exhibit "A" attached hereto; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on July 15, 2004, in the manner prescribed by ordinance and statute, and as a result of said
hearing, the Planning and Zoning Commission did recommend to the City Council the granting of the
Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the requested Conditional Use Permit is
consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health,
safety, morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, II.LINOIS, AS FOLLOWS:
SECTION 1: That the SUBJECT PROPERTY is hereby granted a Conditional Use Permit to
allow the operation of a motor vehicle repair shop subject to the following conditions:
1. All motor vehicle repairs shall be conducted wholly within the building.
2. There shall be no outside storage, including vehicle storage.
3. At least four (4) parking spaces shall be striped on the west side of the building prior to
the issuance of an occupancy permit.
4. The lot on the SUBJECT PROEPRTY shall be paved prior to occupancy.
5. Four (4) planters shall be placed in front of the building on the SUBJECT PROPERTY;
said planters shall be placed prior to the issuance of an occupancy permit.
6. Shrubs shall be planted on the south property line of the SUBJECT PROPERTY in the
green space indicated on Exhibit "B", (the "SITE PLAN'), attached hereto and
incorporated herein, subject to t e engineering eas> > ity ealing with the space
constraints of constructing a curb area at that location.
7. Fencing shall be installed on the SUBJECT PROPERTY as indicated on the SITE PLAN.
S. Signage on the SUBJECT PROPERTY shall not include a monument sign, which would
limit sight line visibility.
9. Down lighting shall be utilized on the SUBJECT PROPERTY to illuminate the rear yard
of the SUBJECT PROPERTY.
SECTION 2: In granting said Conditional Use Permit, the City Council finds that the
requirements of Table 31 of the Zoning Ordinance have been met in that:
1. Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning
district has been minimized.

2. Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light or air, or
other adverse environmental effects of a type or degree not characteristic of permitted uses in
the zoning district, have been appropriately controlled;
3. The proposed use will fit harmoniously with the existing natural or man-made character of its
surroundings, and with permitted uses in the zoning district. The use will not have undue
deleterious effect on the environmental quality, property values, or neighborhood character
already existing in the area or normally associated with permitted uses in the district.
4. The proposed use will not require existing community facilities or services to a degree
disproportionate to that normally expected of permitted uses in the district, nor generate
disproportionate demand for new services or facilities, in such a way as to place undue
burdens upon existing development in the area;
5. The proposed use will not be detrimental to the safety or health of the employees, patrons, or
visitors associated with the use nor of the general public in the vicinity; and
6. The proposed use is in harmony with all other elements of compatibility pertinent to the
Conditional Use and its particular location.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval,
and publication in pamphlet form as provided by law.

Legal Description of the SUBJECT PROPERTY
Part of the West Half of the Northwest Quarter of Section 35, Township 45.North, Range 8, East of
the Third Principal Meridian, described as follows: Commencing at the intersection of the Easterly
right of way line of the Chicago and Northwestern Railway Company and the Southwesterly
boundary of Block 13 of the Original Town of McHenry; thence Southeasterly along the
Southwesterly boundary of said Bock 13, a distance of 139.2 feet, more or less, to the
Northwesterly corner of a parcel of land conveyed by Warranty Deed dated November 1, 1924
from Clara T. Bowers, a widow, to Henry W. Ahrens and recorded in Book 176 of Mortgages, page
32; thence Southwesterly on the Northwesterly boundary of the last described parcel of land
conveyed as aforesaid, a distance of 132 feet to the Southwesterly comer thereof, for a point of
beginning, thence Southeasterly on the Southwesterly boundary thereof, a distance of 129.9 feet,
more or less to an intersection with the Westerly right of way line of the State Highway Route 31
(formerly known as Route 61); thence Southerly on and along said Westerly boundary thereof,
being a curve to the left, having a radius of 3548 feet, an arc distance of 164.89 feet; thence

Proposal
Following is a proposal for property improvements to 913 N. Front Street requiring
Special Use Permit approval. Several changes are planned to both the property and
building to enhance "curb appeal" and improve overall functionality for use as an
automotive maintenance and quick service facility.

The above survey reflects possible improvements via landscaping. Grass and a shallow
curb would be added to the south property line to isolate from adjacent property and
provide a natural look. Grass will also be enhanced in the village owned parkway running
along Front Street. Large planter pots with dwarf evergreens will flank the NE and SE
corners and main entrance of the building. All work will be completed in accordance with
village regulations.
