HomeMy WebLinkAboutOrdinances - ORD-04-1208 - 06/14/2004 - GRANT VARIANCE 6105 TOMLINSONAN ORDINANCE GRANTING A VARIANCE TO PROPERTY LOCATED AT 6105 TOMLINSON DRIVE, FROM CHAPTER 7, ARTICLE I, SECTION 7-27 OF THE CITY OF MCHENRY CODE OF ORDINANCES ENTITLED MINIMUM FLOOR ELEVATION BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois as follows: SECTION 1: That a Variance from Section 7-27 of the City of McHenry Code of Ordinances entitled "Minimum floor elevation" is hereby granted to allow the lowest floor elevation of the building, located at 6105 Tomlinson Drive, which is legally described on Exhibit "A", attached hereto and incorporated herein, the "SUBJECT PROPERTY", to be one (1) foot below the seasonal high water level. Approval of said Variance shall be subject to the following conditions: 1. A multi -ply waterproofing system, with both asphalt emulsion and chopped fiberglass rovings be applied to the foundation. 2. Two (2) one hundred (100) gallon per minute sump pumps be installed in two (2) sewage ejection pits in the basement. 3. Additional exterior and interior drain riles be installed, as deemed necessary by the City of McHenry Building Superintendent, to assist with proper drainage. 4. That said waterproofing system, sump pumps and additional drain tiles be inspected by a 'licensed professional architect or other professional as deemed necessary by the City of McHenry Building Superintendent. SECTION 2: The CITY makes no representation, warranty or guarantee that water infiltration will not occur in the future on the SUBJECT PROPERTY, and the OWNER(S), their successors and assigns, hereby agree to hold the CITY harmless from any future claims arising therefrom SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval, and recordation with the Office of Records and Deeds of McHenry County.
