An Ordinance AuthorizingArceptance of
McHenry County Property to the City of McHenry
BE IT ORDAINED by the City Council of the City of McHenry, McHenry County,
Illinois, as follows:
SECTION 1: That the City Council hereby finds, pursuant to 50 ILCS 602/2, that it is
necessary or convenient for the City to use, occupy and improve the following described real
estate, title of which is currently held by the County of McHenry.
PARCEL 02: THAT PART OF SECTION 2, TOWNSHIP 44 NORTH, RANGE
8, EASE OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS
FOLLOWS: COMMENCING AT THE NORTHWEST CORNER OF THE
NORTHEAST QUARTER OF SAID SECTION 2 AND RUNNING THENCE
SOUTH 01 DEGREES 00 MINUTES 48 SECONDS EAST (BEARING
ASSUMED) ON THE WEST LINE OF THEREOF A DISTANCE OF 1312.78
FEET FOR A POINT OF BEGINNING; THENCE CONTINUING SOUTH 01

FEET; THENCE NORTH 67 DEGREES 37 MINUTES 30 SECONDS EAST, A

02 SECONDS EAST, A DISTANCE OF 351.38 FEET TO THE POINT OF
BEGINNING, IN McHENRY COUNTY, ILLINOIS.
SECTION 2: That the Mayor is hereby authorized and directed to execute the
Agreement to which this Ordinance is attached.
SECTION 3: That the Mayor is hereby authorized and directed to execute any and all
documents necessary to accept title of the Property from the County subject to the terms and
conditions of the Intergovernmental Agreement Between the City of McHenry, McHenry
Township Road District and McHenry County.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval
and publication in pamphlet form (which publication is hereby authorized) as provided by law.
