License With an Exception for a Wine TesVny
Event at the Plum Garden Restaurant
WHEREAS, the Plum Garden Restaurant is the holder of a City of McHenry
Class G liquor license which permits the consumption of alcoholic and malt beverages
only at tables on the premises but does not permit the sale of package liquor; and
WHEREAS, the Plum Garden Restaurant has submitted an application to the
Mayor for a Special Event Liquor License in order to host a wine tasting event which
would include the sale of wine in bottles and cases; and
WHEREAS, the Municipal Code, City of McHenry, Illinois, in paragraph (7) of
Section 4-6, provides for the issuance of a Special Event Liquor License but said
license does not permit the sale of packaged alcoholic liquor; and
WHEREAS, the Mayor and City Council have considered the application of Plum
Garden Restaurant to hold a wine tasting event that would include the sale o' wine
in bottles and cases and conclude that such an event could take place in the City.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF
McHENRY, McHenry County, Illinois, as follows:
SECTION 1: That pursuant to paragraph (7) of Section 46 of the Municipal
Code, City of McHenry, Illinois, a Special Event Liquor License is hereby issued to the
Plum Garden Restaurant for t1QV R 1B FR in , 2002. In conjunction with said
Special Event Liquor License, an exception is hereby granted from said paragraph (7)
of Section 4-6 to permit the sale of wine in bottles and cases during said Special
Event to be held on NOVEMBER 11 2002.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or
provision of this Ordinance shall be adjudged by any Court of competent jurisdiction
to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder
thereof, which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 4: This Ordinance shall be in full force and effect upon its passage,
approval and publication in pamphlet form (which publication is hereby authorized)
as provided by law.
