ORD-02-1057 AN ORDINANCE ANNEXING THE APPROXIMATELY 54 ACRES COMMONLY KNOWN AS THE EAST SIDE OF RIVERSIDE DRIVE, AT MCCULLOM LAKE ROAD, IN MCHENRY COUNTY, ILLINOIS WHEREAS, a written petition, signed under oath, by the legal owners of record of the real estate hereinafter described, has been filed with the City Clerk requesting annexation of said real estate to the City, contingent upon the terms and provisions of an annexation agreement, which petition has been filed in accordance with 65 ILCS 5/7-1-8; and WHEREAS, said real estate is not located within any other municipality or subject to an annexation agreement with any other municipality, and said real estate is presently contiguous to and may be annexed to the City in accordance with 65 ILCS 5/7-1-1, et seq.; and WHEREAS, the City of McHenry does not provide library or fire protection services to said real estate, so notice to the Fire Protection District or Public Library District of the annexation of said real estate is not required; and WHEREAS, The annexation of said real estate will include portions of highway under the jurisdiction of McHenry Township, so notice of the annexation of the said real estate has been served to the McHenry and Township Commissioner of Highways and Board of Town Trustees by certified mail; and WHEREAS, the City has determined that the annexation of said real estate is in the best interest of the City, will promote sound planning and growth of the City, and otherwise enhance and promote the general welfare of the City and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE MAYORAND CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: The real estate legally described on Exhibit A, a complete and accurate plat of said real estate attached to this ordinance and incorporated herein by reference, be and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, including any and all portions of adjacent street, roads or highways as provided by law. SECTION 2: The City Clerk is hereby directed to cause a certified copy of this ordinance, together with said plat, to be recorded in the Office of the Recorder of Deeds of McHenry County, Illinois. Following the recordation of this ordinance and plat, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
