HomeMy WebLinkAboutMinutes - 06/17/1968 - City Council REGULAR MEETING JUNE 17, 1968 The City Council met in regular semi-monthly meeting with Mayor Doherty presiding. Aldermen present: Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Absent: Wegener. Motion by Rogers, seconded by Jackson, to approve the minutes of regular meeting held June 3rd as read. Voting "Aye": Bolger, Etten,Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Absent: Wegener. Motion carried. Motion by Pitzen, seconded by Rogers, to pass and approve the following resolution: "BE IT RESOLVED, that the Mayor and Clerk be and hereby are authorized and directed to execute the approved Quit-Claim Deed to a portion of Lots 24 and 25 of the County Clerk's Plat of part of the South Half of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded May 6, 1902 as Document No. 14084, in Book 2 of Plats, page 38, in McHenry County, Illinois, conveying same to the County Board of School Trustees of McHenry County, Illinois, for the use and benefit of the Board of Education of Community Consolidated School District No. 15, McHenry, Illinois. " Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Absent: Wegener. Motion carried. The following separate action was taken on each matter in the report of the McHenry Zoning Board of Appeals following hearing held on the 11th day of April, 1968 In The Matter Of The Petition Of The City of McHenry For A General Amendment To The Zoning Ordinance And Certain Reclassifications Of Property Under The Provisions Of The Zoning Ordinance Of The City of McHenry As Adopted And Approved On The 12th Day of March, 1962, and As Subsequently Amended: (Copy of Petition attached to these minutes for reference and identification.) Motion by Smith, seconded by Huck, to accept the recommendation of the Zoning Board of Appeals under Paragraph 6. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Regular Meeting - June 17, 1968 #2 Motion by Rogers, seconded by Bolger, to accept the recommendation of the Zoning Board of Appeals under Paragraph 3. Motion by Huck, seconded by Hromec, to accept the recommendation of the Zoning Board of Appeals under Paragraph 4. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Rogers, Smith. Voting "Nay": Pitzen. Absent: Wegener. Motion carried. Motion by Pitzen, seconded by Smith, that no action be taken on recommendation of the Zoning Board of Appeals under Paragraph 5. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Absent: Wegener. Motion carried. Motion by Smith, seconded by Rogers, to reverse the recommendation of the Zoning Board of Appeals under Paragragh 7 and revert to the petition. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Absent: Wegener. Motion carried. Motion by Pitzen, seconded by Jackson, to direct the Board of Local Improvements to institute proceedings for Sanitary Sewer Improvements in the Lakeland Park-Lakeland Shores area of the City of McHenry. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Absent: Wegener. Motion carried. Motion by Huck, sec onded by Bolger, to approve application for transfer of Class "A" Alcoholic Beverage License from Arthur and Leona Henschel to Walter H. Miller and Dorothy M. Miller. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Rogers, Smith. Voting "Nay": None. Motion carried.Absent: Wegener. Approval having been given by the State of Illinois Division of Highways, Alderman Smith, seconded by Alderman Jackson, moved that the City enter into a contract with Aldridge Electric Company in the amount of . 1,250.00 to install left turn traffic signal directing west bound traffic on EZm Street making left turn onto Front Street. Voting "Aye": Bolger, Etten, Hromec, Huck, Jackson, Pitzen, Smith. Voting "Nay": Rogers. Absent: Wegener. Motion carried. PETITION 1. This petition is brought by the City of McHenry, through its duly authorized and directed City Attorney, for the purpose of requesting the Zoning Board of Appeals of the City of McHenry to consider and make -N. recommendations to the City Council of the City of McHenry as to the general amendment and reclassifications of properties as are set forth hereinafter. 2. Under the provisions of the Municipal Code of the City of McHenry all properties annexed are automatically placed in the IIR-1" Single Family District (40, 000 square foot minimum area) classification in order to permit an examination of the areas and a reclassification which will be in harmony with the general area. Petitioner represents to the Board that the following described premises are all presently classified "R.1" Single Family District through the application of the Municipal Code provisions due to annexation and Petitioner requests the consideration of the Board to reclassify these premises "R-3" Single Family District (10, 000 square foot minimum area): a. Lots 12 and 13 in Block 2 in Hay Heights, a Subdivision LOOZE & KINN.E of Lots 3 to 8 in Kelter Estate Subdivision, Unit No. 2, ATTORNEYS 3431 W.ELM STREET McHENRY. ILLINOIS - 1 - i .ft...4 . Petitioner states that the premises described in this para- graph are presently classified "R-1" Single Family District (40, 000 square foot minimum area), also as a result of annexation, and requests the consideration of the Board to recommend a reclassification of these premises to "R-2" Single Family District (20, 000 square foot minimum area) as being most suitable: a. Lots 1 and 2 in Kelter Estate Subdivision, Unit No. 1, a Subdivision of part of the North Half of Section 34, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded March 14, 1949 as Document No. 218953, in Book 10 of Plats, page 112, in McHenry County, Illinois. b. Petitioner requests the consideration of the Board concerning premises described as follows: a. All of Lots 1, 2, 3 and 4 in Shady Crest Subdivision, being a Subdi vision of part of the Northwest Quarter of the Southeast Quarter of Section 27, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded June 13, 1957 as Document No. 324222, in Book 13 of Plats, page 28, in McHenry County, Illinois. b. All of Lots 20, 21, 22 and 23 of the County Clerk's Plat of the Northwest Quarter of the Southeast Quarter of Section 27, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois. The above-described premises are presently classified "R-1" Single Family District (with a minimum area of 40, 000 square feet), also as a result of annexation, and it is the opinion of the Petitioner that a suitable compatible use classification, or combination of classifications, should be made in regard to these premises in either "R-2" Single Family District (with a minimum area of 20, 000 square feet), "R-3" Single Family District (with a minimum area of 10, 000 square feet), or "B-1" Commercial Retail District. 5. Petitioner represents to the Zoning Board of Appeals that the - following described premises are presently classified "B-1" Commercial LOOZE & KINNE Retail District under the provisions of the Zoning Ordinance of the City of ATTORNEYS 3491 W.ELM STREET McHENRY, ILLINOIS - 3 - --, I I McHenry and have been so zoned for six years, with no development of business upon any of these properties, or in the general surrounding area, during that time: Lots 1 through 5 in Block 22, Lots 1 through 8 in Block 21, and Lots 1 through 8 in Block 20 in the Original Plat of McHenry on the West side of Fox River, a Subdivision of part of the Southeast Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded July 6, 1840 in Book B of Deeds, page 160, in McHenry County, Illinois. It is the position of the Petitioner that the reclassification of these pre- mises under the "R-3" Single Family District (with a minimum area of 10, 000 square feet) would be more reasonable and in the best interests of the owners of these premises. Petitioner is also of the opinion that such a classification would preserve contiguous parcels of property for future off-street parking needs in that the residential classification would not permit "spotting" of small businesses which would destroy the Conti- ! guity of property needed to accommodate adequate parking facilities. 6. It is the opinion of the Petitioner that the central business area of the City can be best preserved, enlarged, and improved, and adequate parking facilities established, by classifying all properties "B-1" Commercial Retail District, not presently so classified, in the following described area: That land which lies North of Waukegan Road from the West line of Green Street to the East line of Front Street, lying South of Illinois State Route 120 from the East line of Front Street to the West line of Green Street and lying West of Green Street from the South line of Illinois State Route 120 to the North line of Waukegan Road. 7. Petitioner requests consideration of an amendment to the Zoning Ordinance of the City of McHenry by adding to Article IX, "B-1" Commercial Retail District, Section A., the following permitted use: LOOZE & KINNE ATTORNEYS 9431 W.ELM STREET MCHENRY, ILLINOIS - 4 - a �1 I �. (-a) Automobile Service Stations, not required to be operated within an enclosed area. Provided that no automobile service station shall be permitted within 600 feet of any existing automobile service station. WHEREFORE, your Petitioner prays that the Chairman of the Zoning Board of Appeals of the City of McHenry set a date, time and place for a hearing on the contents of this petition and to cause proper publication of notice to be made concerning same; to take testimony and view exhibits as presented at such hearing and, as a result thereof, submit its recommendations to the City Council of the City of McHenry in regard to the matters and things herein contained.
