HomeMy WebLinkAboutOrdinances - ORD-01-1046 - 12/03/2001 - GRANT ZONING VERONICA ESTATES 412 N FRONT STORDINANCE NO.ORD-01-1046 AN ORDINANCE GRANTING A ZONING MAP AMENDMENT TO THE APPROXIMATELY 1.365 ACRES, Lot 3 OF VERONICA ESTATES SUBDIVISION, LOCATED AT 412 N FRONT STREET IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, a petition has been filed with the City requesting a zoning map amendment to 0-2, Office Park District for the approximately 1.365 acres, Lot 3 of Veronica Estates Subdivision, located at 412 N Front Street, described and depicted on Exhibit A attached hereto and incorporated herein by reference; and WHEREAS, a public hearing on said petition was held before the Zoning Board of Appeals on October 18, 2001, in the manner prescribed by ordinance and statute, and as a result of said hearing, the Zoning Board of Appeals did recommend to the City Council the granting of the requested zoning change; and WHEREAS, the City Council has considered the evidence and recommendation from the Zoning Board of Appeals and finds that the approval of the zoning change currently requested and approved by this ordinance is consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals and general welfare of its residents. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: That the property commonly known as Lot 3 of Veronica Estates Subdivision and included in the property legally described and depicted on Exhibit A, attached hereto and incorporated herein by reference, be granted a Zoning Map Amendment to 0-2, Office Park District. SECTION 2: In granting said Zoning Map Amendment, the City Council finds that the requirements of Table 33 of the Zoning Ordinance have been met in that: The requested zoning classification is compatible with the existing uses and zoning of property in the environs, 2. The requested zoning classification is supported by the trend of development in the general area; 3. The requested zoning classification is consistent with the objectives of the City of McHenry Comprehensive Plan; and 4. The requested classification promotes the public interest. SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. The entire parcel of which the property is a part is legally described as follows: Part of the Northwest Quarter of the Southwest Quarter of Section 35, Township 45 North, Range 8 East of the Third Principal Meridian, lying on the Easterly side of the State Highway, described as follows: Commencing at the West Quarter corner of Section 35; thence Easterly on the East and West Quarter Section line, 715.0 feet to an intersection with the East line of the State Highway (now known as Route No. 31); thence Southerly on the East line of said State Highway, 655.0 feet, for a place of beginning; thence Easterly on a line parallel with said East and West Quarter Section line 590.41 feet to an intersection with the East line of the Northwest Quarter of the Southwest Quarter of said Section; thence Southerly on said line thereof 148.04 feet; thence Westerly on a line parallel with said East and West Quarter Section line 586.74 feet to an intersection with the East line of said State Highway; thence Northerly on the East line of said highway, 148.02 feet, to the place of beginning, in McHenry County, Illinois.
