ORDINANCE NO. ORD-01-1031
AN ORDINANCE GRANTING ZONING MAP AMENDMENTS TO THE 600 ACRE
PROPERTY COMMONLY KNOWN AS THE SHAMROCK FARM, LOCATED ON THE
NORTH AND SOUTH SIDES OF DRAPER ROAD, WEST OF CURRAN ROAD, AND
INCLUDING ACREAGE LOCATED ON THE EAST SIDE OF CURRAN ROAD,
IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the City requesting zoning map
amendments for the Shamrock Farm, including RA-1, Attached Residential (2 parcels), RS-
2, Medium -Density Single -Family Residential (1 parcel), and RS-1, Low -Density Single -
Family Residential (1 parcel); and
WHEREAS, a public hearing on said petition was held before the Zoning Board of
Appeals on September 11, 2000, and continued to October 16, 2000, in the manner
prescribed by ordinance and statute, and as a result of said hearing, the Zoning Board of
Appeals did recommend to the City Council the granting of part and the rejection of part of
the requested zoning changes; and
WHEREAS, the City Council has considered the evidence and recommendation
from the Zoning Board of Appeals and finds that the approval of the zoning changes
currently requested and approved by this ordinance is consistent with the objectives of the
City of McHenry Zoning Ordinance to protect the public health, safety, morals and general
welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the property commonly know as the Shamrock Farm, divided into
four parcels for the purpose of rezoning, be granted the following:
A Zoning Map Amendment to RA-1, Attached Residential, for 2 parcels,
described and depicted on Exhibit 1 and Exhibit 2, attached hereto and
incorporated herein by reference; and
2. A Zoning Map Amendment to RS-2, Medium -Density Single -Family Residential,
for 1 parcel, described and depicted on Exhibit 3, attached hereto and
incorporated herein by reference; and
3. A Zoning Map Amendment to RS-1, Low -Density Single -Family Residential, for 1
parcel, described and depicted on Exhibit 4, attached hereto and incorporated
herein by reference.
SECTION 2: In granting said Zoning Map Amendments, the City Council finds that
the requirements of Table 33 of the Zoning Ordinance have been met in that:
The requested zoning classification is compatible with the existing uses and
zoning of property in the environs;
2. The requested zoning classification is supported by the trend of development in
the general area;
3. The requested zoning classification is consistent with the objectives of the City of
McHenry Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
