AN ORDINANCE AMENDING THE CIRCULATION AND LAND USE PLAN
FOR THE NIMC CAMPUS, APPROVED BY ORDINANCE 0-97-818,
TO PERMIT A NEW HELIPORT AT 4309 RING ROAD,
IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed with the City by NIMED Corp. requesting
amendments to the "Circulation and Land Use Plan" for the NIMC campus, approved by
Ordinance 0-97-818, to remove the restriction on refueling equipment for a Heliport and
add a new Heliport area to the southwest of the existing helipad; and
WHEREAS, a public hearing on said petition was held before the Zoning Board
of Appeals on December 4, 2000, in the manner prescribed by ordinance and statute,
and as a result of said hearing, the Zoning Board of Appeals did recommend to the City
Council the granting of the requested amendments; and
WHEREAS, the City Council has considered the evidence and recommendation
from the Zoning Board of Appeals and finds that the approval of the requested
amendments is consistent with the objectives of the City of McHenry Zoning Ordinance
to protect the public health, safety, morals and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the "Circulation and Land Use Plan" for the NIMC campus,
approved by Ordinance 0-97-818, is hereby amended as follows:
A. That the NIMC "Circulation and Land Use Plan" map, prepared by Teska
Associates, Inc., dated 3/12/97, and attached to Ordinance 0-97-818 as
"Exhibit D", is hereby replaced in its entirety by the NIMC "First Amended
Circulation and Land Use Plan" map, prepared by Teska Associates, Inc.,
dated 8/7/00 attached hereto and incorporated herein by reference as
Exhibit A.

B. That Section I. Use Groups, Heliport Area (Page 2) of the "Circulation and
Land Use Plan" for the NIMC campus, attached to Ordinance 0-97-818 as
"Exhibit D - Circulation and Land Use Plan Attachments", is hereby
replaced in its entirety with the following "1. Heliport, with or without
hangar and/or refueling equipment, to be located within the heliport area
shown on the Circulation and Land Use Plan."
SECTION 2: In granting said amendments to the NIMC "Circulation and Land
Use Plan", the City Council finds that the requirements of Table 33 of the Zoning
Ordinance have been met in that:
1. The requested zoning classification is compatible with the existing uses
and zoning of property in the environs;
2. The requested zoning classification is supported by the trend of
development in the general area;
3. The requested zoning classification is consistent with the objectives of the
City of McHenry Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and
provisions hereof are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, McHenry County,
Illinois.

SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
