HomeMy WebLinkAboutOrdinances - ORD-00-987 - 09/20/2000 - ANNEX 2.4 AC RUBLOFF PROPERTYORDINANCE NO.ORD-00-987 AN ORDINANCE ANNEXING A 2.4-ACRE PROPERTY LOCATED ON THE NORTH SIDE OF MCCULLOM LAKE ROAD, APPROXIMATELY 500-FEET SOUTHEAST OF OLDE MILL LANE, IN MCHENRY COUNTY, ILLINOIS (RUBLOFF PROPERTY) WHEREAS, a written petition, signed under oath by the legal owner of record and all Electors residing on the real estate hereinafter described, has been filed with the City in accordance with 65 ILCS 5/7-1-8, of the Illinois Municipal Code, requesting annexation of said real estate to the City; and WHEREAS, said real estate is not located within any other municipality or subject to an annexation agreement with any other municipality, and said real estate is presently contiguous to and may be annexed to the City in accordance with 65 ILCS 5/7-1-1, et seq., of the Illinois Municipal Code. WHEREAS, the City of McHenry does not provide library or fire protection services to said real estate, so notice to the Public Library District or Fire Protection District of the annexation of said real estate is not required; and WHEREAS, said real estate does not include right-of-way which is not currently under the jurisdiction of the City of McHenry, therefore, no notice of the annexation is required to the McHenry Township Commissioner of Highways and the Board of Township Trustees; and WHEREAS, upon annexation, said real estate will receive a zoning classification of E, Estate, pursuant to Article III, Section D, of the Zoning Ordinance of the City of McHenry, and will be used for a private access road to be built meeting City standards; and WHEREAS, the City has determined that the annexation of said real estate is in the best interest of the City, will promote sound planning and growth of the City, and otherwise enhance and promote the general welfare of the City and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL. OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: The real estate legally described on Exhibit A, a complete and accurate plat of said real estate attached to this ordinance and incorporated herein by reference, be and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, including any and all portions of adjacent street, roads or highways as required by law. SECTION 2: The City Clerk is hereby directed to cause a certified copy of this ordinance, together with said plat, to be recorded in the Office of the Recorder of Deeds of McHenry County, Illinois. Following the recordation of this ordinance and plat, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois., SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law.
