AN ORDINANCE GRANTING A ZONING MAP AMENDMENT TO A 1-ACRE
PROPERTY LOCATED ON THE EAST SIDE OF ROUTE 31, SOUTH OF THE FAP
420 RIGHT-OF-WAY, IN MCHENRY COUNTY, ILLINOIS (RUBLOFF PROPERTY)
WHEREAS, a petition has been filed with the City by Rubloff Development Group
requesting a zoning map amendment to C-5, Highway Commercial, for a 1-acre
property located on the east side of Route 31, south of the FAP 420 right-of-way; and
WHEREAS, a public hearing on said petition was held before the Zoning Board
of Appeals on July 17, 2000, in the manner prescribed by ordinance and statute, and as
a result of said hearing, the Zoning Board of Appeals did recommend to the City Council
the granting of the requested zoning map amendment; and
WHEREAS, the City Council has considered the evidence and recommendation
from the Zoning Board of Appeals and finds that the approval of the requested zoning
map amendment is consistent with the objectives of the City of McHenry Zoning
Ordinance to protect the public health, safety, morals and general welfare of its
residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the property commonly known as a 1-acre property located on
the east side of Route 31, south of the FAP 420 right-of-way, and legally described
below, is hereby granted a zoning map amendment to C-5, Highway Commercial.
LEGAL DESCRIPTION
That part of the Southeast Quarter of Section 23, Township 45 North, Range 8
East of the Third Principal Meridian, described as follows: Commencing at the
Northwest corner of the Southeast Quarter of said Section 23 and running thence
South on the West line thereof for a distance of 1363.16 feet to a point; thence
East at right angles to the last described line at the last described point for a
distance of 82.5 feet to a point for the place of beginning; thence continuing
Easton the last described line for a distance of 210.01 feet to a point; thence
South at right angles to the last described line at the last described point for a
distance of 200 feet to a point; thence West at right angles to the last described
line at the last described point for a distance of 223.41 feet to a point which is
69.10 feet East of the West line of said Southeast Quarter; thence Northeasterly
125.14 feet to a point which is 75 feet East of the West Line of said Southeast
Quarter; Thence northeasterly75.38 feet to the place of beginning, in McHenry
County, Illinois. Containing 44,000 square feet of land, more or less.
SECTION 2: In granting said zoning map amendment, the City Council finds that
the requirements of Table 33 of the Zoning Ordinance have been met in that:
1. The requested zoning classification is compatible with the existing uses
and zoning of property in the environs;
2. The requested zoning classification is supported by the trend of
development in the general area;
3. The requested zoning classification is consistent with the objectives of the
City of McHenry Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and
provisions hereof are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, McHenry County,
Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
