AN ORDINANCE ANNEXING HILLTOP ELEMENTARY SCHOOL,
2615 W. LINCOLN ROAD, IN MCHENRY COUNTY, ILLINOIS
WHEREAS, the Board of Education of McHenry Community Consolidated School
District No. 15, McHenry and Lake Counties of Illinois, adopted a Resolution at its regular
meeting held May 23, 2000, recommending that the City annex the real estate commonly
known as Hilltop Elementary School, 2615 W. Lincoln Road, and legally described on
Exhibit A, a complete and accurate plat of said real estate attached to this ordinance and
incorporated herein by reference; and
WHEREAS, said Resolution was adopted and has been filed with the City Clerk in
accordance with 65 ILCS 5/7-1-14, of the Illinois Municipal Code-, and
WHEREAS, upon annexation, said real estate will receive a zoning classification of
E, Estate District, pursuant to Article III, Section D, of the Zoning Ordinance of the City of
McHenry, but that within 120 days following annexation, District No. 15 will file all materials
necessary in request that said real estate be rezoned for approval of a public school facility-,
and
WHEREAS, no electors reside on said real estate, said real estate is contiguous to
the corporate limits of the City of McHenry, and is not located within any other municipality;
and
WHEREAS, said real estate will not be disconnected from any public library district
or fire protection district, therefore, notice is not required to be given to those authorities-,
and
WHEREAS, said real estate includes right-of-way currently under the jurisdiction of
McHenry Township, therefore, notice of the annexation has been provided to the Township
Commissioner of Highways and the Board of Township Trustees by certified mail; and
WHEREAS, the City of McHenry has determined that the annexation of said real
estate is in the best interest of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYORAND CITY COUNCIL OF
THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1: The real estate commonly known as Hilltop Elementary School, 2615
W. Lincoln Road, and legally described and depicted on Exhibit A, a complete and accurate
plat of said real estate attached to this ordinance and incorporated herein by reference, be
and the same is hereby annexed to and made a part of the corporate limits of the City of
McHenry, including any and all portions of adjacent street, roads or highways as required by
law.
SECTION 2: The City Clerk is hereby directed to cause a certified copy of this
ordinance, together with said plat, to be recorded in the Office of the Recorder of Deeds of
McHenry County, Illinois. Following the recordation of this ordinance and plat, a copy
thereof shall be filed in the Office of the Clerk of McHenry County, Illinois.
SECTION 3- This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
