TUESDAY, OCTOBER 23, 1979 7:30 P.M.
Special Meeting of the City Council was called to order by Mayor
Stanek on Tuesday, October 23, 1979 at 7:30 P.M. for the purpose of considering
and acting on the following matters: Main Street Sidewalk Ordinance, RDG
law suit update, John Street parking adjacent to the Methodist church property,
Real Estate Taxes and discussion on Main Street from Route 31 to Crystal Lake
Road. At roll call the following aldermen were present: Pepping, Nolan,
Harker, Datz, Schooley, Meurer. Absent: Wieser, Adams.
Following discussion between Councilmen and property owners on the
south side of John Street, Motion by Harker, seconded by Datz , to put 8k feet
of =I nd 8k feet of blacktop on the tree bank on the north side of John
Street between Center and Fourth Streets.
Voting Aye: Nolan, Harker, Datz, Meurer, Stanek.
Voting Nay: Pepping.
Pass: Schooley.
111 Absent: Wieser, Adams.
Motion carried.
Mayor Stanek instructed Harker, Nolan or Meurer to contact the
Methodist Church and find out what the seating capacity of their remodeled
church will be and how many parking spaces will be provided in the parking lot.
Motion by Harker, seconded by Schooley, to pass a Sidewalk Ordinance
which concerns property owners who refuse to repair sidewalks on a participation
basis with the city.
Voting Aye: Pepping, Nolan, Harker, Datz, Schooley, Meurer.
Voting Nay: None.
Absent: Wieser, Adams.
Motion carried.
Attorney Narusis presented a report on delinquent Real Estate Taxes
which are payable by the City. These include: 9 lots donated to the city
associated with the Lakeland Park drainage ditch; 5 parcels of land in Whispering
Oaks donated for use as open space and nature walks; Petersen Park property;

the former Schreiner property on which the library addition is constructed
& the former McHenry Savings &Loan property which the city purchased for a
parking lot. These properties are now tax exempt and have been since January
1, 1977. The taxes due are for years prior to that time, many lots and parcels
having had back taxes owned on them when donated to the city.
Motion by Nolan, seconded by Harker, to authorize Narusis to get
a clear title from the McHenry Title Company for a lot on Freund Avenue
in the A.P. Freund Millstream Addition which was offered to the city for
payment of back taxes due on that lot.
Voting Aye: Pepping, Nolan, Harker, Datz, Schooley, Meurer.
Voting Nay: None.
Absent: Wieser, Adams.
Motion carried.
Motion by Meurer, seconded by Schooley, to pay the delinquent
real estate taxes on the Peterson property, the Elm-Green Street parking
lot and the library property.
Voting Aye: Pepping, Nolan, Harker, Datz, Schooley, Meurer.
Voting Nay: None.
Absent: Wieser, Adams.
Motion carried.
The Mayor instructed Chairman Pepping of the Finance Committee
and Attorney Narusis to determine the best method of redeeming the back tax
property in the Lakeland Park and Whispering Oaks areas.
After discussion on the proper method to use in attempting to get
Main Street between Route 31 (Front Street) and Crystal Lake Road designated
as an FAU route so it would be eligible for federal funding, the Mayor
instructed Assistant Supt. of Public Works Randy Meyer to contact the
Illinois Department of Transportation as to the proper procedure to follow.

Motion carried.
