Mayor Stanek called to order the recessed Public Hearing of the Falcon Company Annexation Proceedings for the purpose of considering and 111 acting upon an annexation agreement proposal and related ordinances on Thursday, October 11, 1979 at 7:42 P.M. At roll call the following aldermen were present: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Absent: None. Also in attendance were: Attorney Bernard Narusis, City Clerk Gilpin, Supt. of Public Works Fred Meyer of the City of McHenry; Developers and Petitioner Larry and Jerry Falcon and their attorney, Philip Grossman all of Falcon Development Company; Co-Petitioner Edward Neumann and his attorney, Donald Truckenbrod; City Engineer Dr. Hal Sundin of Baxter & Woodman; Spectators Joan Kerlow, Linda Hogan and Catherine Meyer; Newspaper Reporter Tony Oliver and a Court Reporter. Attorney Narusis reported that he and petitioner's attorney had incorporated all the recommendations made by the City Council at prior hearings into the annexation agreement presented tonight. He advised that several minor language changes, one additional paragraph and a revised Exhibit E should be inserted into the agreement. These changes were all made with the approval of the Falcon's and their attorney. Petitioners told the Council they would submit $50,000.00 as required under terms of the annexation agreement within ten (10) days. Attorney Narusis suggested that the related Ordinances should be passed tonight and the Mayor and Clerk should be instructed not to sign any documents until all required fees have been paid to the Clerk. It was the consensus of opinion of the Council that Narusis suggestion be approved. Motion by Harker, seconded by Nolan, to pass an Ordinance approving the annexation agreement with Falcon Development Company. Voting Aye: Pepping, Nolan, Harker, Datz, Wieser, Adams, Schooley, Meurer. Voting Nay: None. Absent: None. Motion carried. Thursday, October 11, 1979 Page 2 Motion by Nolan, seconded by Schooley, to pass an Ordinance annexing the Falcon Development Company territory, it being approximately 125 acres of land between Route 31 and Riverside Drive north of the City. Voting Aye: Nolan, Harker, Datz, Schooley, Adams, Meurer, III Pepping, Wieser. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Datz, to pass an Ordinance zoning the Falcon Development Company property as R-1 subject to Special Use for a Planned Unit Development. Voting Aye: Nolan, Harker, Datz, Schooley, Adams, Meurer, Pepping, Wieser. Voting Nay: None. Absent: None. Motion carried. III The Mayor and Clerk were authorized to sign all documents relating to annexation of the property in question upon receipt of all proper fees. Motion by Adams, seconded by Wieser to adjourn the Public Hearing. Voting Aye: Nolan, Harker, Datz, Schooley, Adams, Meurer, Pepping, Wieser. Voting Nay: None. Absent: None. Motion carried.
