MONDAY, AUGUST 20, 1979 8 P.M.
The Regular Meeting of the City Council was held on
August 20 , 1979 . The meeting was called to order by Mayor
Stanek at 8 P.M. At roll call the following aldermen were
present : Harker, Datz , Wieser, Adams , Schooley, Meurer, Nolan,
Pepping. Absent : None .
Motion by Nolan, seconded by Adams , to accept the min-
utes of the August 6 , 1979 Regular Meeting as read with one
correction.
Voting Aye : Harker, Datz , Wieser, Adams , Schooley, Meurer,
Nolan, Pepping .
Voting Nay: None .
Absent : None.
Motion carried.
The City Attorney stated that the City ' s 1956 Waterworks
and Sewerage Revenue Bond Ordinance requires that a certificate
or letter of the engineer in responsible charge of any future
necessary improvements , extensions , repairs and rehabilitation
to the City' s combined Waterworks and Sewerage System be filed
with the Mayor and City Council , be approved by them and be
made a Public Record before any action is taken by the govern-
ing body to authorize the issuance of any additional Waterworks
and Sewerage Revenue Bonds .
The Clerk thereupon stated that she had received a letter
from Baxter E Woodman, Inc . , sanitary and environmental engi-
neers , dated August 16 , 1979 and addressed to the Mayor and
City Council relating to the scope, costs and necessity of
the expansion of the City' s Sewerage Treatment Plant and that
a photocopy thereof had been distributed to the Mayor and Alder-
ment prior to the meeting.
The attached Resolution (Exhibit "A") approving Baxter &
Woodman, Inc . ' s letter of August 16 , 1979 aforesaid and making
it a Public Record was read by the City Attorney to the City
Council .

Motion by Harker, seconded by Nolan, to pass a Resolution
(Exhibit "A") to approve the letter read by the City Attorney
from City Engineer ' s Baxter Woodman, Inc . dated August 16 ,
1979 which sets forth and certifies the matters and things des-
cribed in Section 9 of the 1956 City Revenue Bond Ordinance
for Waterworks and Sewerage Bonds and make said letter a Public
Record, and approve the plans , maps , files and specifications
for the expansion of the City' s sanitary waste treatment faci-
lities which were prepared by Baxter Woodman, Inc . as author-
ized by the Mayor and City Council - - this Resolution being
passed before any action is taken by the governing body to
authorize issuance of additional Waterworks and Sewerage Revenue
Bonds .
Voting Aye : Harker, Datz , Wieser, ADams , Schooley, Meurer,
Pepping , Nolan.
Voting Nay: None .
Absent : None .
Motion carried.
Motion by Schooley, seconded by Meurer , to approve the
plans , maps , files and specifications for the expansion of
the sanitary waste treatment plant prepared by Baxter
Woodman, Inc . as authorized by the Mayor and City Council
and to ratify all prior action taken by the City Council re-
garding bid advertisement and awarding of the bid.
Voting Aye : Harker , Datz , Wieser , Adams , Schooley, Meurer,
Pepping , Nolan.

Baxter Woodman, Inc . ' s letter of August 16 , 1979 ,
approved and
having bee /made a Public Record and all plans and specifi-
cations for expansion of the sewerage treatment plant having
been approved, the City Council took the new bond ordinance
under consideration.

Motion by Harker, seconded by Pepping , to pass an Ordin-
ance, a copy of which is attached hereto as Exhibit "B" ,
authorizing the issuance of $1 , 150 , 000 . 00 of Waterworks and
Sewerage Revenue ]Jonds , Series of 1979 , of the City of McHenry,
McHenry County, Illinois , and providing for the payment and
delivery thereof.
Voting Aye : Harker, Datz , Wieser, Adams , Schooley, Meurer,
Pepping, Nolan.
Voting Nay: None .

Motion carried.
Motion by Schooley, seconded by Adams , to approve the
Preliminary Plat of Chapel Hill Oaks Unit 1 as presented which
is within the 12 mile jurisdiction of the City of McHenry on
the east side of Chapel Hill Road.
Voting Aye : Harker, Datz , Wieser, ADams , Schooley, Meurer,
Pepping, Nolan.
Voting Nay: None .

Mayor Stanek declared a recess at 8 : 37 P .M. The meeting
reconvened at 8 : 49 P.M. with all aldermen still in attendance .
Supt. of Public Works Fred Meyer reported on the bid
opening for a road grader which took place August 20 , 1979
at 10 A.M. in City Hall with the following bids received:

Motion by Meurer, seconded by Harker , to authorize the
purchase of a John Deere Model JD670-A road grader (Option 5)
from West Tractor Sales of Naperville at a price of $58 , 519 . 00
and authorize the sale of the City ' s 1955 Galion road grader
for $5 , 000 . 00 with the balance of $53 , 519 . 00 to be paid from
the following funds : Off Street Parking - $8 , 000 . 00 ; Water/
Sewer Funds - $4 , 000 . 00 ; Park Funds - $4 , 000 . 00 and $37 , 000 . 00
from Public Works Funds .

Motion by Schooley, seconded by Harker, to authorize the
purchase of a FMC Brush Chipper, Model c-16 , from Schuster
Equipment Co . of Chicago at a price of $8 ,625 . 00 .

Pepping, Nolan.

Motion by Pepping, seconded by Datz , to pass the 1979-80
Fiscal Year Levy Ordinance as recommended by the Finance Com-
mittee and to publish the ordinance in pamphlet form.

Pepping, Nolan.

Motion by Harker, seconded by Wieser, to authorize Ander-
son Tree Service to cut down and remove dead trees in the city
at the direction of Supt . Meyer.

Pepping, Nolan.

Motion carried.
Motion by Datz , seconded by Nolan, to pass a Resolution
authorizing payment to Hampton, Lenzeni and Renwick, engineers
for the Washington Street SOS project , less 5 percent reten-
tion fee, with payment to be made from the Motor Fuel Tax
Fund, which is $5 , 217 . 39 less 5 percent equals $4 , 956 . 52 with
reimbursement to be made by the Federal Government .

Following 35 minutes of discussion, Motion by Nolan,
seconded by Pepping, that out of respect for the legal rights
of parties who might not be aware of the informal meeting
scheduled for August 21 , 1979 , regarding re-zoning proposal
of Residential Development Group for property previously
zoned as a golf course in the original PUD Ordinance of
Boone Valley and in order to preserve the integrity of the
zoning function, the previously scheduled informal meeting
of August 21 , 1979, will be cancelled.

Pepping , Nolan.

Mayor Stanek read a letter of resignation from Willis
Martin of the Planning Commission, effective August 20 , 1979

because he was moving out of state . The Mayor reluctantly
accepted the letter and expressed gratitude to Martin for the
many services he had performed for the City.
Motion by Pepping , seconded by Wieser , to instruct
Attorney Narusis to draw up an Ordinance authorizing the pay-
ment of $10 . 00 to Zoning Board and Plan Commission members for
every officially scheduled meeting of their respective boards
that they attend, effective September 1 , 1979 .

Clerk Gilpin asked that a Public Property Committee
Meeting be scheduled at an early date to consider a proposal by
Illinois Bell Telephone Company for updating the entire tele-
phone and communications system in city hall including the
Police, Public Works and Clerk ' s departments .
Regarding a request from the Johnsburg School Dist-
rict for use of city tennis courts , the Park Committee recom-
mended that the school be permitted to use two tennis courts
at Freund Field three days a week. Park Director Peter Merkel
was instructed to inform the school .
Motion by Wieser, seconded by Datz , to grant a Tag
Day on October 27 , 1979 for the McHenry TumbleweeC , a girl ' s
tumbling group.

The Building and Zoning Committee recommended that a
Aign for White Hen Pantry and Bob ' s Paint Store be located on
the lot line between the two businesses on Elm Street .
