AND RDG PUBLIC HEARING
MONDAY, JULY 16, 1979 8 P.M.
The regular meeting of the City Council was held on Monday, July
16, 1979. The meeting was called to order by Mayor Stanek. At roll call
the following aldermen were present: Harker, Datz, Wieser, Adams, Schooley,
Meurer, Pepping, Nolan. Absent: None.
Motion by Nolan, seconded by Datz, to accept the minutes of the
July 2, 1979 regular meeting as read.
Voting Aye: Harker, Datz, Wieser, Adams, Schooley, Meurer,
Pepping, Nolan.
Voting Nay: None.
Absent: None.
Motion carried.
John Langdon, representing the McHenry City Police Officers
Association, presented athletic equipment to the Park Committee as a
donation from the Association for use in city parks. Baseballs, bats,
a badminton set, basketballs, and nets were displayed at the meeting.
Alderman Nolan, as Chairman of the Park Committee, and Mayor Stanek
expressed gratitude to the McHenry City Police Officers Association on
behalf of the Council and residents of the City.
Motion by Harker, seconded by Nolan, to pass an Ordinance providing
for approval of the proposed RDG-Backhaus Farm Annexation Agreement and to
authorize the Mayor and Clerk to sign the Agreement.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan, Stanek.
Voting Nay: Wieser, Adams.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Datz, to pass an ordinance providing
for the annexation of the RDG-Backhaus Farm to be named Winding Creek Sub-
division.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan.
Voting Nay: Wieser, Adams.
Absent: None.
Motion carried.

Motion by Pepping, seconded by Nolan, to pass an ordinance
amending the Zoning Ordinance of the City of McHenry for RDG-Winding
Creek Subdivision as specified in the ordinance.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan.
Voting Nay: Wieser, Adams.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Meurer, to pass an ordinance
amending the Zoning Ordinance of the City of McHenry specifying the
Planned Unit Development portion of the RDG-Winding Creek Subdivision.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan,
Stanek.
Voting Nay: Wieser, Adams.
Absent: None.
Motion carried.
Donald Gersted, president of RDG, presented a check for $50,000.00
to Mayor Stanek and the Council in compliance with the terms of the
Annexation Agreement.
Preliminary and Final Plat of RDG-Winding Creek Subdivision
Unit #1 was presented for approval. Following discussion, motion by
Harker, seconded by Nolan to approve the Preliminary and Final Plat of
Winding Creek Unit #1 as presented and to authorize the Clerk to sign
the Plat after all specified conditions are met.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan.
Voting Nay: Wieser, Adams.
Absent: None.
Motion carried.
Mayor Stanek declared a recess at 8:57 P.M. The meeting
reconvened at 9:08 P.M. At roll call all aldermen were present.

Jeffrey Ladd, attorney for objectors of the RDG-Backhaus Farm
annexation, addressed the Council and said he was disappointed but not
surprised at the Council's action tonight. He was shocked and appalled
at the rapidity of final plat approval. He stated that the objectors'
intentions had not changed and he hoped the council would not be lulled
into a false sense of security just because a law suit was not filed in
the next 24 or 48 hours.
Supt. Fred Meyer reported on the bid opening held 10:30 A.M.
July 16, 1979 for the 1979 Summer Street Maintenance Program. Two bids
were received - Peter Baker Co. of Woodstock, $127,201.50 and Curran
Contracting Co. of Crystal Lake, $120,757.50.
Motion by Schooley, seconded by Harker, to award the 1979
Summer Street Maintenance bid to Curran Contracting Co. of Crystal
Lake for $120,757.50 and to authorize the Mayor and Clerk to sign the
contract.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan,
Wieser, Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Datz, seconded by Harker, to pass an ordinance annexing
33.9 acres south of the city known as Knox Park.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan,
Wieser, Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Datz, to accept the City Treasurer's
June report as read.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan,
Wieser, Adams.
Voting Nay: None.

Motion carried.
Motion by Adams, seconded by Datz, to postpone the Public
Hearing on the annexation proposal of Falcon Development Co. from
July 23, 1979 to Aug. 15, 1979 at 8 P.M.
Voting Aye: Harker, Datz, Schooley, Meurer, Pepping, Nolan,
Wieser, Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Pepping, to postpone the informal
hearing on the annexation proposal of Jack Fritsch from July 18, 1979 to
Aug. 1, 1979 at 8 P.M.

Chief of Police Passnelli reported that records for the first
quarter of 1979 show that the overall crime rate in the city is down 33k%.
The mayor and council complimented the Police Department and the people of
McHenry for this noteworthy decline in the crime rate.
Motion by Adams, seconded by Wieser, to authorize the issuance
of the first half of the uniform and cleaning allowance checks to Police
Department personnel.

Wieser, Adams.
Voting Nay: None.

Motion by Nolan, seconded by Adams, to return the bid bond of
Peter Baker & Sons who was the unsuccessful bidder on the 1979 Summer
Street Maintenance Program.

Wieser, Adams.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Adams, to issue a tag day permit
for Aug. 11, 1979 to the Lily Lake Conservation Club.

Motion by Wieser, seconded by Adams, to deny a request by the
McHenry Tumbleweeds, a girls power tumbling group, for a tag day in August
because (1) they did not specify what the funds would be used for and
(2) only two tag days a month are allowed and two are already committed
in August.

Wieser, Adams.

Session at 10:15 P.M. to discuss pending litigation.
